WHAT AN HONOR AND PRIVILEGE IT IS TO COME BEFORE YOUR THRONE OF GRACE THIS EVENING, KNOWING YOU'RE FULLY AWARE OF ALL OUR SITUATIONS WE'RE IN, AND WE WANT TO SAY THANK YOU FOR OUR BEAUTIFUL TOWN, OUR BEAUTIFUL STATE, AND OUR BEAUTIFUL COUNTRY THAT YOU BLESSED US WITH, THAT WE CAN LIVE PEACEFULLY AND RAISE OUR FAMILIES IN COMFORT AND SECURITY.
AND FATHER, I ASK THAT YOU BLESS THIS MEETING.
BLESS EACH ONE THAT'S A PART OF THIS MEETING.
AND BLESS US TO YOUR SERVICE, FATHER, AND ALL THAT WE DO.
WE LOVE YOU IN JESUS NAME, AMEN.
ALL RIGHT. WE'LL BE MOVING ON TO PRESENTATIONS OF THE 2023 RED KETTLE CHALLENGE REPORT.
[D. PRESENTATION(S)]
I'D LIKE TO INTRODUCE MISS MARY FREEMAN, THE COUNTY DIRECTOR OF COMMUNITY RELATIONS WITH THE SALVATION ARMY.ANSWER AND I HAVE CHANGED MY APPEARANCE.
MAJOR DUANE DURHAM HERE WITH SALVATION ARMY.
I, ALONG WITH MY WIFE, MAJOR MARION.
SORRY YOU GOT THE LESS ATTRACTIVE OF THE TWO.
WE BOTH SERVE WITH THE SALVATION ARMY BASED IN LEWISVILLE, AND WE GREET YOU TONIGHT, AND I HAVE BRIDGET MCINTOSH WITH ME.
SHE'S OUR VOLUNTEER SPECIALIST FOR COLLIN AND DENTON COUNTIES FOR THE SALVATION ARMY, NORTH TEXAS.
SO I WANT TO THANK YOU, MAYOR DEREK FRANCE AND, CITY LEADERS, FOR PARTICIPATING IN THE 2023, AREA, MAYORS RED KETTLE CHALLENGE.
SO YOUR LEADING, INSPIRED THREE OTHER MAYORS TO PARTICIPATE IN THE CHALLENGE IN 2023.
AND SO WE HAVE A CERTIFICATE THAT I WANT TO PRESENT YOU IN JUST A MOMENT.
AND WE'RE, PLEASED TO BE ABLE TO DO THAT.
SO WE'RE GOING TO GIVE YOU A NICE BIG BRASS BELL TO KEEP.
AND IF YOU WANT TO USE THAT THIS YEAR, WE PRAY THAT YOU WOULD, JOIN US AGAIN IN THIS, BUT WE'RE HAPPY TO REPORT, YOU KNOW, THAT, WE HAVE OUR YEAR ROUND PROGRAMS ADDRESSING POVERTY AND STABILITY, FOR FOLKS AND HOMELESSNESS AND PEOPLE WITH ADDICTIONS AND YOUR, EFFORTS WITH THE RED KETTLE CHALLENGE, WITH THE MAYORAL CHALLENGE RAISED $800 IN ONE DAY.
AND, AND THEN $110 RAISED THROUGH THE VIRTUAL, RED KETTLE.
SO THANK YOU SO MUCH FOR THAT.
ALL FOUR OF THE TEAMS TOGETHER RAISED A TOTAL OF $5,391 IN DONATIONS.
AND SO WE VERY MUCH APPRECIATE YOU HELPING US TO GIVE HOPE AND HELP TO NEIGHBORS IN NEED.
AND JUST VERY QUICKLY, I'LL SHARE A STORY OF NEIGHBORS SAM AND DONNA.
AND THEY'RE IN THEIR 80S AND THEY NEEDED, YOU KNOW, THEY HAVE TO MAKE THOSE TOUGH DECISIONS ABOUT WHERE THEIR, VERY SMALL INCOME GOES. AND THEY NEEDED PRESCRIPTION HELP, THEY NEEDED HELP WITH UTILITIES, AND THEIR HOME AND
[00:05:01]
THEIR HEALTH WAS IN JEOPARDY.AND SO, OUR CASE MANAGEMENT SPECIALIST WAS ABLE TO GO TO, SIT DOWN WITH THEM AND HELP THEM, TO, HAVE SOME FOOD AND PAY FOR SOME UTILITIES AND SOME PRESCRIPTIONS, SO THAT THEY CAN BE, HELPED AND, HAVE A BETTER LIFE.
AND SO WE'RE GRATEFUL BECAUSE SUPPORT LIKE WHAT YOU HAVE GIVEN THROUGH THE RED KETTLE CHALLENGE MAYORAL CHALLENGE HELPS US TO DO THIS.
SO, AND WE ARE, YOU KNOW, WE SEE CONTINUE TO SEE DEMANDS FOR HELP.
AND OF COURSE, WE ALL KNOW THE COSTS OF LIVING.
AND SO YOUR HELP, IT GIVES HOPE TO OTHERS.
SO ONE THING I WOULD ADD IS THAT WE ARE HAPPY THAT IN LEWISVILLE, WITH OUR FACILITY AT 880 FOX AVENUE, WE FINALLY HAVE THE RENOVATIONS COMPLETE THAT WE'VE BEEN WORKING ON FOR A WHILE, AND WE WOULD LOVE FOR YOU TO COME AND TOUR THAT, EIGHT AGAIN, 880 FOX AVENUE, SALVATION ARMY, AND YOU CAN SEE YOUR GENEROSITY IN ACTION.
YOU COULD EVEN USE IT NOW IF YOU WANT.
SCOOT OVER A LITTLE BIT THAT WAY.
ALL RIGHT. AND THEN LOOK UP THERE.
BECAUSE THAT'S WHERE EVERYONE AT HOME IS WATCHING.
THANK YOU SO MUCH. THANK YOU SO MUCH.
ALL RIGHT. WITH THAT, WE'LL BE MOVING ON TO ITEM E PUBLIC COMMENT.
[E. PUBLIC COMMENT]
AS A REMINDER, THE PURPOSE OF THIS ITEM IS TO ALLOW THE PUBLIC AN OPPORTUNITY TO ADDRESS THE TOWN COUNCIL REGARDING ANY ITEM ON THIS AGENDA THAT IS NOT MARKED AS A PUBLIC HEARING. ISSUES REGARDING DAILY OPERATIONAL OR ADMINISTRATIVE MATTERS SHOULD FIRST BE DEALT WITH BY CALLING TOWN HALL AT (972) 874-6000 DURING NORMAL BUSINESS HOURS.TO SPEAK TO TOWN COUNCIL TONIGHT PLEASE FILL OUT ONE OF THESE GREEN COMMENT FORMS. SPEAKERS WILL BE LIMITED TO THREE MINUTES.
A TONE WILL SOUND WHEN YOU HAVE 30 SECONDS LEFT AND AGAIN WHEN YOUR TIME HAS EXPIRED.
STARTING TONIGHT WILL BE MISS CHERYL MOORE.
I LIVE AT 1900 TENNYSON DRIVE IN FLOWER MOUND.
THANK YOU, TOWN COUNCIL AND MAYOR FOR ALLOWING ME TO SPEAK TONIGHT.
I AM RUNNING FOR THE CANDIDACY FOR MAYOR, AND THAT'S WHY I'M HERE TONIGHT.
I'M INVITING YOU TO VOTE IN THIS ELECTION ON MAY 4TH AND CHOOSE YOUR CANDIDATE BY EVALUATING WHO WE ARE. JUST A LITTLE BIT ABOUT ME.
I'VE LIVED IN FLOWER MOUND FOR 18 YEARS.
I HAVE A 20 YEAR OLD AND AN 18 YEAR OLD NOW.
I'VE BEEN MARRIED FOR 25 YEARS.
PROFESSIONALLY, I'M A PHYSICAL THERAPIST.
EVERYBODY COMES UP TO ME AND SAYS, MY BACK HURTS.
CAN YOU MASSAGE ME? THAT'S NOT EXACTLY WHAT I DO.
I ENSURE COMPLIANCE STANDARDS IN HEALTH CARE FACILITIES.
I'VE BEEN A REGIONAL DIRECTOR OF OPERATIONS.
I'VE MANAGED FACILITIES, EIGHT FACILITIES WITH 16 EMPLOYEES, DIRECTING MEETINGS, PROVIDING TRAINING.
I'VE WORKED WITH ADMINISTRATORS FOR FINANCIAL MANAGEMENT AND BUDGETING.
I'VE DONE MARKETING ACCREDITATION FOR HEALTH CARE FACILITIES FOR HEALTH CARE COMPLIANCE.
[00:10:04]
I'M ALSO TRAINED IN BEHAVIORAL MANAGEMENT AND PROVIDE TRAINING TO STAFF.I'VE BEEN TRAINED IN DE-ESCALATION STRATEGIES AND PROVIDE TRAINING TO STAFF.
I'VE BEEN TRAINED IN SOCIAL TRAFFICKING, PROFILING VIOLENCE.
SO I'M VERY ADEPT WITH WORKING WITH, STAFF AT ALL LEVELS, INCLUDING EVERYBODY THAT'S INVOLVED IN SAFETY, OUR FIRE FIGHTERS, OUR POLICE OFFICERS.
THEN I BESIDES, PROFESSIONALLY, I GOT INVOLVED IN THE COMMUNITY I'VE BEEN ON, I STARTED GETTING INVOLVED, JUST IN MY COMMUNITY, WITH MY NEIGHBORS IN THE LISD.
I WAS A PRESIDENT OF OUR HOA, AND THEN I RAN FOR MAYOR BECAUSE I GOT SO INVOLVED.
AND THERE WERE FIVE OF US AT THAT TIME.
THERE'S ONLY TWO OF US THAT I'VE REALLY SEEN OUT AND ABOUT.
I GOT INVOLVED IN THE CITIZENS POLICE ACADEMY, THE LEADERSHIP PROGRAM WITH THE CHAMBER OF COMMERCE AND THE CITIZENS ACADEMY NOW.
MY PLATFORM IS THE SAME AS IT WAS THREE YEARS AGO.
PUTTING RESIDENTS FIRST PRESERVE OUR GREEN SPACES AND HELP LOCAL BUSINESSES THRIVE.
THE STRATEGIC PLAN IS ONE THAT I SUPPORT.
AND NOW I'VE BEEN ON THE, PNZ COMMISSION AND THE VICE CHAIR OF THE TRANSPORTATION COMMISSION.
I THINK YOU SHOULD CAREFULLY EVALUATE.
I THOUGHT I WAS GOING TO HAVE TIME DONATED TO ME.
BUT ANYWAY, I WANTED TO IDENTIFY THE DIFFERENCES, AND I'M SORRY WE WON'T BE ABLE TO DO THAT.
OKAY? THANK YOU, THANK YOU, I APPRECIATE IT.
I LIVE AT 10605 SUNRISE CIRCLE FLOWER MOUND, TEXAS 76226.
I STAND BEFORE YOU TONIGHT AGAIN, BRINGING A DOCUMENT THAT YOU HAVE SEEN QUITE A FEW TIMES NOW.
2022 CONSENT ITEMS. THESE CONSENT ITEMS WERE PUSHED THROUGH BY THE MAJORITY OF TOWN COUNCIL MEMBERS THAT ARE SITTING IN FRONT OF US TONIGHT.
SOME OF YOU ARE NEW NUMBER 12 SUNRISE CIRCLE WASTEWATER CONNECTION DESIGN.
CONSIDER APPROVAL FOR A PROFESSIONAL SERVICES AGREEMENT WITH JONES AND CARTER, INC.
IT'S JUST WHAT WE WERE PROMISED.
YOU AS A TOWN COUNCIL EARLIER THIS YEAR, HAVE NOW REFUSED TO PROVIDE US WITH WASTEWATER SERVICES.
YOU SPENT $40,000 IN TAXPAYER FUNDS TO DESIGN A PROJECT THAT ESSENTIALLY YOU'RE UNWILLING TO PUT IN.
MY COMMUNITY IS ONE OF THE POOREST WITHIN THE TOWN OF FLOWER MOUND.
THEY NEVER HAVE. THIS IS THE PROJECT.
THIS IS WHAT WAS SPENT $40,000 OF OUR TAXPAYER FUNDS.
YET YOU ARE UNWILLING TO PUT IT INTO MY NEIGHBORHOOD.
[00:15:02]
THIS WENT OUT FOR BID.WE QUESTION HOW WE GOT THIS FAR, $40,000 WASTED.
IT WAS TO PUT IN SEWAGE LINE APPROXIMATELY LOOKING AS THE GREEN LINE ABOVE WOULD.
I AND MY FELLOW COMMUNITY MEMBERS HAVE QUESTIONS OVER WHAT IS OCCURRED WITHIN OUR TOWN.
I HAVE I HAVE BETTER THINGS TO DO.
YES. BUT THESE ARE THE QUESTIONS THAT WE AS A TOWN NEED TO BE RAISING.
AND FIRST AND FOREMOST, I SUPPORT ANYONE WHO RUNS FOR MAYOR WHO IS WILLING TO IMPLEMENT A RESIDENCY AND OWNERSHIP REQUIREMENT TO BE THE MAYOR OF OUR TOWN.
WE CANNOT HAVE JORGE SANTOS RUNNING OUR TOWN.
THANK YOU SIR. THERESA DO WE HAVE ANY MORE GREEN COMMENT CARDS? DO NOT. IS THERE ANYONE IN THE AUDIENCE THAT WISHES TO SPEAK DURING PUBLIC COMMENT? PLEASE STAND UP OR RAISE YOUR HAND.
ALL RIGHT. SEEING AND HEARING NONE.
[F. ANNOUNCEMENTS]
I'LL START WITH MY RIGHT WITH MR. SCHIESTEL. THANK YOU MAYOR.AND THE FIRST ONE STARTS TOMORROW.
EARLY VOTING FOR THE PARTISAN PRIMARY STARTS TOMORROW.
IT CONTINUES UNTIL MARCH 1ST, AND ELECTION DAY IS ON MARCH 5TH, AND YOU WILL HAVE FIVE LOCATIONS IN FLOWER MOUND TO VOTE AT THE, CANYON FALLS COURTHOUSE, THE CAC, THE MUNICIPAL COURT, THE LIBRARY, AND THE SENIOR CENTER.
SO PLEASE, IF YOU'RE INTERESTED IN VOTING IN THESE PRIMARIES, VOTE EARLY.
IT APPEARS THAT THERE'S GOING TO BE A LOT OF TURNOUT.
THAT'S WHY THERE'S SO MANY LOCATIONS.
SO GO KNOCK IT OUT TOMORROW IF YOU CAN.
AND, THEN YOU'LL BE VOTING AGAIN IN ABOUT SIX WEEKS.
THANK YOU. SO LAST MEETING I TALKED ABOUT THE CITIZEN'S POLICE ACADEMY.
WELL, THIS WEEK IT'S TIME TO OPEN UP THE APPLICATION FOR THE CITIZENS FIRE ACADEMY.
A COURSE THAT I'VE TAKEN, A WONDERFUL COURSE.
GOT AN INSTRUCTOR SITTING, STANDING RIGHT IN THE BACK.
AND YOU CAN APPLY BY GOING TO FLOWER-MOUND.COM/CITIZENSFIREACADEMY.
ENCOURAGE YOU TO DO IT. IT'S A GREAT COURSE.
YOU GET TO CUT UP CARDS, YOU GET TO PUT OUT FIRES.
BE A REAL FIREFIGHTER FOR A DAY.
DON'T FORGET TO CHECK FLOWER-MOUND.COM/EVENTS FOR OUR EVENTS CALENDAR.
ONE OF THOSE THAT I'M LOOKING FORWARD TO IS THE FATHER DAUGHTER PROM ON MARCH 16TH.
SO I HOPE TO SEE YOU GUYS ALL THERE.
[G. TOWN MANAGER'S REPORT]
WITH THAT, WE'LL BE MOVING ON TO OUR TOWN MANAGER'S REPORT, AND I'LL START IT OFF WITH OUR TOWN MANAGER, MR. CHILDERS. THANK YOU, MAYOR, AND GOOD EVENING TO YOU AND THE REST OF COUNCIL.THE FIRST ONE. I'M VERY EXCITED.
LAST WEEK WE PUT OUT A PRESS RELEASE ANNOUNCING OUR NEXT CFO IS BEEN HIRED, AND, HE'S WITH US TONIGHT, AND I'M ASKED, JOHN ZAGORSKY TO TO STAND AND HIS FAMILY TO STAND WITH HIM.
I'M. YEAH THE DAUGHTER HAD THAT LOOK ON HER FACE LIKE, OH, MY GOSH.
BUT, NO, WE'RE VERY EXCITED TO HAVE JOHN ON BOARD.
WE'VE, APOLOGIES TO DREW CORN, MY COUNTERPART OVER IN NORTH LAKE.
WE POACHED THEM FROM NORTH LAKE, WHERE HE WAS THE FINANCE DIRECTOR.
AND PREVIOUS TO THAT, HE WORKED IN THE TOWN OF TROPHY CLUB.
AND JOHN BRINGS A LOT OF GREAT EXPERIENCE ON BOARD.
MORE IMPORTANTLY, WHAT I'M EXCITED ABOUT A LOT OF INNOVATION.
AND THAT'S IMPORTANT BECAUSE HE HAS A LOT OF CONNECTIONS AROUND THE STATE OF TEXAS.
AND, HE'S CHOMPING AT THE BIT TO GET STARTED.
HIS START DATE IS ON MARCH THE 18TH.
HE'S ALREADY IN THE PROCESS OF HIRING A BUDGET DIRECTOR.
I THINK YOU'RE DOING INTERVIEWS THIS WEEK, SO HE'S RARING TO GO AND READY TO GET IN PLACE.
[00:20:10]
TO KICK OFF IN A FEW WEEKS.WITH THAT BEING SAID, TAMMY IS OVER THERE.
I'M NOT I'M NOT GOING TO MAKE YOU DO ANYTHING, TAMMY.
BUT, TAMMY IS GOING TO BE WITH US, PROBABLY FOR THE NEXT MONTH OR SO.
SHE'S HELPING CLOSE OUT THE PREVIOUS YEAR.
SHE'S GOING TO ASSIST JOHN IN THE TRANSITION.
BUT, IF YOU WERE AN EAGLE EYE, YOU MAY HAVE NOTICED THAT JOHN WAS ACTUALLY HERE LAST WEEK.
AND WHAT I'M GOING TO TOUCH ON ARE FOR INDIVIDUALS WHO ARE OUR STARS, SO TO SPEAK.
AND WE YOU SEE THE WOI CHAMPS AND YOU SEE A BELT IN THE BACKGROUND.
AND SO WHAT WE'VE DONE IS, IS THAT WE TRY TO FIGURE OUT A FUN WAY TO LEAN INTO OUR VALUES AND OUR VALUES ARE WE ARE AUTHENTIC, WE ARE EXCEPTIONAL, WE ARE DEDICATED, WE ARE FAMILY AND ALL THAT COMES TOGETHER AS WE OWN IT.
AND I'M GOING TO SHOW A VIDEO.
MAYBE WE'LL SEE TIM IF IT GOES THROUGH.
BUT I'M GONNA ASK ANDREA SCHRICKER TO, TO TO STAND ANDREA THE GIANT.
AND SHE'S OUR INAUGURAL WOI CHAMP.
AND, WHAT ANDREA DID IS THAT WHAT'S REALLY COOL ABOUT HER IS THAT SHE IS A TOWN RESIDENT, AND SHE JUST HAPPENED TO BE ON NEXT DOOR, AND WE HAD AN ELDERLY RESIDENT HERE THAT WAS ON NEXT DOOR JUST KIND OF SHARING THIS TERRIBLE EXPERIENCE SHE HAD, WITH A CONTRACTOR THAT QUOTED HER AN EXORBITANT PRICE TO HAVE TO REMEDY A SEWAGE ISSUE THAT SHE HAD IN HER HOME.
SHE WAS BASICALLY FREAKING OUT AND THINKING, OH MY GOSH, I'M ABOUT TO SELL MY HOUSE.
ALL THESE DIFFERENT TYPES OF THINGS.
ANDREA TOOK IT UPON HERSELF TO REACH OUT TO THAT RESIDENT, TELL HER SHE WORKS WITH THE TOWN, GET A LITTLE BIT MORE INFORMATION, AND WITH ANDREA'S HELP, SHE WAS ABLE TO FIGURE OUT THERE WERE SOME THINGS THAT WE COULD DO ON OUR END WITH OUR UTILITY MAINTENANCE CREWS.
AND NEEDLESS TO SAY, IT WASN'T WHAT WAS ORIGINALLY QUOTED.
AND THIS LADY WAS, CAME TO THE O&M AND BROUGHT COOKIES AND CAKES AND TREATS AND ALL THOSE THINGS.
SHE TOOK HER OWN TIME AND ENERGY TO REACH OUT TO, ANOTHER RESIDENT AND HELP REMEDY HER SITUATION.
SO, ANDREA GETS TO GO DOWN IN HISTORY AS OUR INAUGURAL WOI CHAMP.
SO OUR SECOND WOI CHAMP IS STEPHANIE BILLARREAL.
STEPHANIE, RAISE YOUR HAND IN THE BACK.
SHE'S ONE OF OUR FIRE PREVENTION OFFICERS.
A COMMON THEME IS, IS OUR EMPLOYEES GO ABOVE AND BEYOND, AND ANDREA DOES A, EXCUSE ME, ANDREA.
EXCUSE ME, STEPHANIE DOES A LOT OF WORK.
A LOT OF PRESENTATIONS, FIRE CITIZENS ACADEMY, THINGS OF THAT NATURE.
BUT WHAT'S REALLY UNIQUE ABOUT AND WHY SHE WON THE AWARD FOR OUR SECOND QUARTER IS THE FACT THAT SHE WENT ABOVE AND BEYOND AND WORKING WITH ONE OF THE PARTICIPANTS WHO HAPPENED TO HAVE AUTISM.
AND WHAT'S REALLY COOL AND VERY IMPACTFUL ABOUT THIS IS NOT ONLY WAS THIS YOUNG MAN COMFORTABLE, THE CONFIDENCE THAT HE HAD WITH IT IS HE CONTINUED TO VOLUNTEER FOR US AFTER THE FACT. AND SO WE WENT FROM A SCENARIO WHERE WE WERE JUST TRYING TO GET SOMEBODY COMFORTABLE WITH THE PROGRAM TO WHERE THEY FELT EMPOWERED AND CONFIDENT ENOUGH TO CONTINUE
[00:25:04]
TO VOLUNTEER WITH US GOING FORWARD.AND SO, STEPHANIE, WENT THE EXTRA MILE.
AND SO, STEPHANIE, WHAT DID WE SAY YOUR WRESTLING NAME WAS STUNNING STEPHANIE.
AND SO SHE WAS OUR SECOND QUARTER WOI CHAMP.
SO LET'S GIVE STEPHANIE A HAND.
ALL RIGHT. AND SO FOR THE THIRD QUARTER, WE HAD AUGUSTINE SANASEROS WITH OUR IT DEPARTMENT.
HE'S BACK THERE TRYING TO LOOK COOL.
YOU KNOW, WHAT'S WHAT'S UNIQUE ABOUT AUGUSTINE? AND JUST WHAT SHOWS WHAT HE BRINGS TO THE TABLE IS THAT AUGUSTINE PULLED OFF A REAL COOL TRIFECTA.
AND IT'S ALL REFLECTIVE OF THE WORK SPIRIT THAT AUGUSTINE HAS.
HE'S ONE OF THOSE GUYS THAT WE HAVE IN ALL OF OUR ORGANIZATIONS WHERE YOU JUST SAY THEIR NAME AND EVERYBODY NODS AND SAY, YEAH, HE'S HE'S THE GUY, AND HE JUST GOES TO EXTRA MILE OF SUPPORTING HIS CUSTOMERS.
HE WAS VERY INSTRUMENTAL DURING OUR TRANSITION.
ONE OF HIS BOSSES, THEY WERE WORKING ON A NETWORK PROJECT.
A ONE OF HIS BOSS'S KIDS EVENTS CAME UP, AND AUGUSTINE JUST SAID, I GOT IT, MAN.
GO. YOU KNOW, HE HE HANDLED THAT AND HELPED OUT THAT BALANCE.
AND SO AUGUSTINE IS JUST A REAL CALMING AND GREAT PRESENCE WE HAVE ON OUR IT DEPARTMENT.
AND HE IS OUR THIRD QUARTER WOI CHAMP.
SO LET'S GIVE AUGUSTINE A HAND.
AND SO, TIM, IF YOU'RE IN THERE, CAN WE PLAY THE VIDEO FOR THIS ONE? WE HAVE ABOUT A 3 OR 4 MINUTE VIDEO.
LET'S SEE IF WE CAN BAIL OUT OF THIS AND PUT THAT VIDEO UP.
AND THIS WILL GIVE YOU A SENSE OF HOW WE APPROACH THESE THINGS.
YOU SEE THAT I RULE. ALL RIGHT TY, HEARD YOU WAS GUNNING FOR THE BELT.
AND SO, UNFORTUNATELY, THE AMAZING AUGUSTINE, I GUESS HE GOT ROUGHED UP IN HIS LAST MATCH.
SO WE HAVE, NO WAY JOSE HERE WITH OUR WOI CHAMPIONSHIP.
AND I'M GIVING IT TO YOU, TY, FOR THE GREAT WORK THAT YOU DID.
YOU KNOW WHAT'S WHAT'S REALLY COOL? AND BY THE WAY, WE'RE KEEPING OUR WRESTLING THEME.
SO YOU GOT OLD SCHOOL CLASSIC MINISTRY OF DARKNESS, UNDERTAKER.
SO YOU GOT YOU GOT YOU GOT A FLOWER MOUND BACK HERE.
BUT WHAT'S REALLY COOL ABOUT YOURS IS THAT ASSISTANT CHIEF DUFFIELD, SUBMITTED.
YOU AND ALSO CURTIS, THEY REFERENCED A WRECK THAT Y'ALL CAME UPON BACK IN NOVEMBER.
WHAT'S REALLY COOL ABOUT THIS IS THAT THE WAY THAT CHIEF DUFFIELD DESCRIBES IT, HE SAW THE TOWN VEHICLE KIND OF PARKED TO THE SIDE OF THE ROAD, AND HE JUST ASSUMED, OH, GOD, WE WERE IN A WRECK. AND HE CAME UP AND HE FOUND THAT YOU GUYS, NOTICE A MOTHER AND A CHILD THAT WAS PART OF THAT WRECK AND IT WAS RAINING.
AND RATHER THAN THEM SITTING OUTSIDE, YOU PUT THEM IN THE TRUCK, Y'ALL STOOD OUT IN THE RAIN.
AND I HAD TO KIND OF CATCH MYSELF BECAUSE THAT'S THAT'S REALLY EPITOMIZES WHAT WE'RE ALL ABOUT.
I CAN'T THINK OF A BETTER CASE OF AUTHENTICITY, OF SOMEBODY JUST SAYING THAT.
IT'S VERY EASY AND WE'RE ALL GUILTY OF THIS AND SOMETIMES WE COME ACROSS A WRECK.
YOU JUST SEE OTHER PEOPLE ARE ON THEIR PHONES AND YOU'RE JUST LIKE, OKAY, SOMEBODY HAS IT.
FROM WHAT I UNDERSTAND IS A BAD WRECK.
IT'S THAT, YOU KNOW, 82,000 WHO LIVE IN THEIR RESIDENCE IN THIS TOWN AND THE PEOPLE WHO COME THROUGH IT, YOU KNOW, YOU KNOW, YOU'RE TALKING ABOUT TENS OF THOUSANDS OF PEOPLE TO COME TO, THEIR PART OF THE FAMILY, TOO.
SO I CAN'T THINK OF A BETTER RECIPIENT THAN YOU TY.
IN ADDITION TO YOU GET TO HOLD ON TO THE BELT FOR A QUARTER.
DON'T DO ANYTHING CRAZY WITH IT.
BUT ALSO ON YOUR NEXT CHECK, YOU'LL GET $100 POST TAXES.
SO WE WANT TO MAKE SURE YOU GET THE FULL AMOUNT SO YOU'LL HAVE AN EXTRA 100 ON YOUR CHECK.
HOPEFULLY YOU DON'T GET ROUGHED UP LIKE AMAZING AUGUSTINE DID.
AND THEN WE'LL HAVE TO SEND MANNY IN YOUR PLACE.
MANNY HAS TO COME UP WITH A WRESTLING NAME.
BUT THANK YOU FOR EVERYTHING YOU DO, MAN.
EVERY QUARTER I JUST KEEP, YOU KNOW, YOU JUST FIGURE OUT HOW CAN IT GET BETTER, HOW CAN IT GET BETTER? AND THE UNIQUE THING IS EVERYTHING'S A LITTLE BIT DIFFERENT.
[00:30:03]
BUT AGAIN, YOU GUYS WENT ABOVE AND BEYOND AND SERVING, THE LADY AND HER BABY.AND, JUST EXCEPTIONALLY PROUD TO BE A PART OF AN ORGANIZATION THAT HAS SOMEBODY LIKE YOU TY.
THANK YOU. ALL RIGHT, ALL RIGHT.
SO Y'ALL CAN CONTINUE WITH YOUR FAKE MEETING OR Y'ALL HAVE LEGIT STUFF TO DO, BUT, NO, MAN.
GREAT JOB, GREAT JOB. THANK YOU.
AND EARLY ON I USED TO TRY TO DO THE WRESTLING VOICE AND I COULDN'T, I COULDN'T KEEP IT UP.
SO I JUST, I JUST GAVE UP AND TALK NORMAL.
BUT AGAIN, TY, I HAVE STAND UP AND TY TY IS TRYING TO BE BASHFUL IN THE BACK.
LET'S GIVE TY A ROUND OF APPLAUSE.
SO JUST WANTED TO SHARE A LITTLE BIT OF THIS.
AND LAST BUT CERTAINLY NOT LEAST, ONE THING THAT I DO WANT TO DO BEFORE, IF YOU HAVE ANY QUESTIONS TO FOLLOW UP, IS, IS THAT, CHIEF HENLEY, WHY DON'T YOU STAND UP IN THE BACK? SO DON'T.
IT'S LIKE, WHAT DO YOU. YOU KNOW WHAT I'M TALKING ABOUT.
BUT, CHIEF HENLEY, ONE OF THE THINGS WE JUST WANT TO TAKE THE TIME TO RECOGNIZE.
WE'RE VERY FORTUNATE TO HAVE TWO GREAT CHIEFS.
SO A GREAT POLICE CHIEF, AND A GREAT FIRE CHIEF.
AND CHIEF HENLEY, GOT A GREAT RECOGNITION FROM THE TEXAS FIRE CHIEFS ASSOCIATION.
HE IS THE 2024 RECIPIENT OF THE LONE STAR ACHIEVEMENT AWARD.
AND HIS PEERS RECOGNIZED HIM WITH THE LONE STAR ACHIEVEMENT AWARD.
SO I JUST WANT TO SAY CONGRATULATIONS TO CHIEF HENLEY.
ALL RIGHT. SO I KNOW I WENT THROUGH A LOT PRETTY FAST.
DID Y'ALL HAVE ANY QUESTIONS REGARDING OUR WOI PROGRAM OR ANYTHING THAT I SHARED TONIGHT? COUNCIL. NO JOB WELL DONE JAMES.
THANK YOU MAYOR. SO WE'LL MOVE ON TO FUTURE AGENDA ITEMS.
[H. FUTURE AGENDA ITEM(S)]
DOES ANYBODY FROM COUNCIL HAVE ANY FUTURE AGENDA ITEMS THEY WOULD LIKE TO DISCUSS? I'LL START WITH MY LEFT WITH MR. TAYLOR. YEAH, I HAVE ONE.I WANT TO HAVE A WORK SESSION ITEM TO DISCUSS EXPANDING SPAN, SERVICES TO ADDRESS ADDITIONAL NEEDS FOR FOR PUBLIC TRANSPORTATION FOR OUR RESIDENTS, SPECIFICALLY GOING TO THE AIRPORT, OR GOING TO BUSINESSES OUTSIDE OF OUR TOWN, OR EVEN BRINGING SENIORS AND DISABILITY DISABLED INDIVIDUALS INTO OUR TOWN TO SUPPORT OUR LOCAL BUSINESSES.
COUNCIL. IS IT JUST A WORK SESSION TO TALK? YEAH, JUST TO UNDERSTAND COST.
WE'LL KNOW THE COST. YEAH. WHAT OPTIONS WE DO HAVE.
I'M OKAY WITH THAT. ALL RIGHT.
JAMES, IF YOU COULD, ADD THAT TO ONE OF THE FUTURE WORK SESSIONS.
SO, MARCH IS FILLING UP PRETTY QUICK.
WE'LL, TRY TO GET IT ON THERE.
APRIL IS GOING TO BE DESIGNATED, FOR OUR, BUDGET WORK, WORK SESSION.
AND I THINK I UNDERSTOOD FROM MR. DREW THAT WE JUST KIND OF WANTED TO BETTER UNDERSTAND THE CONTRACT VEHICLE AND AND HOW IT GOES, YOU KNOW, ABOUT MAYBE EXPANDING IT AND WHAT ADDITIONAL COSTS, WHAT OTHER COMMUNITIES ARE DOING AND THINGS LIKE THAT.
THANK YOU. COORDINATION OF CALENDARS.
[I. COORDINATION OF CALENDARS]
WE HAVE OUR NEXT MEETING ON MARCH 4TH.IT'S A REGULAR MEETING. WILL EVERYONE BE AVAILABLE FOR THIS MEETING DATE? EXCELLENT. NO ZOOMING.
[J. BOARDS/COMMISSIONS]
BOARDS AND COMMISSIONS.JUST AS A REMINDER, WE HEARD FROM MR. JOHN TRAVIS LAST THURSDAY WHO HAD APPLIED TO SERVE ON THE VETERANS LIAISON BOARD.
[00:35:02]
A BOARD IF SELECTED, AND WHAT RELEVANT EXPERIENCE DO THEY HAVE TO SERVE ON THE BOARD THAT THEY'VE APPLIED FOR? APPLICANTS THIS EVENING, PLEASE TRY TO KEEP YOUR REMARKS TO 3 TO 5 MINUTES.FIRST UP, WE'LL HAVE MISS DAWN SHAPLEY, WHO APPLIED TO SERVE ON OUR HISTORICAL COMMISSION.
MY NAME IS DAWN SHAPLEY, AND I'VE BEEN IN THE AREA.
I LIVED HERE SINCE 1990 WHEN MY HUSBAND AND I GRADUATED FROM TEXAS A&M.
ALSO, CURRENTLY, I'M ALMOST WRAPPED UP WITH MY MBA FOR, WITH A FOCUS ON NONPROFIT MANAGEMENT.
AND SO ANYWAY, I JUST THINK A LOT OF THOSE, EDUCATIONAL BACKGROUND SKILLS CAN, HELP THE COMMISSION.
I'VE SERVED AS THE CHILDREN'S PASTOR AT VALLEY CREEK CHURCH FOR MANY OF THOSE YEARS.
SO I KNOW LOTS AND LOTS OF PEOPLE IN FLOWER MOUND.
AND MOST RECENTLY, I'VE HAD THE ROLE OF OVERSEEING ALL THE LOCAL MISSIONAL WORK THAT WE DO.
SO AGAIN, I'M OUT IN THE COMMUNITY A LOT.
THAT IS MY JOB, AND I'M VERY PASSIONATE ABOUT THE TOWN OF FLOWER MOUND.
I LOVE OUR TOWN. I THINK WE HAVE A LOT OF HISTORY THAT, EVEN THOUGH WE'RE A YOUNG TOWN, THERE'S A LOT THAT WE COULD CAPTURE, AND I JUST REALLY WANT TO PRESERVE THAT FOR FUTURE GENERATIONS. YOU KNOW, I LIVED OVER CLOSER TO WHERE WE'RE IN WEST FLOWER MOUND.
THANK YOU DAWN. COUNCIL, DO YOU HAVE ANY QUESTIONS FOR THE APPLICANT? ANY. ANY TOUGH ONES? I HOPE IT'S NOT TOUGH.
AND I DO THINK THAT THERE ARE SOME, OBJECTIVES THAT COULD BE AND JUST SOME, SOME GOALS.
SO THERE'S I LOOKED INTO SOME OTHER CITIES THAT ARE DOING SIMILAR THINGS AND THOUGHT OTHERS REALLY A LOT OF GOOD OBJECTIVES THAT YOU CAN PUT OUT THERE AND JUST SUBMIT TO YOU GUYS FOR YOUR APPROVAL.
ALL RIGHT. THANK YOU, MA'AM, I APPRECIATE IT.
THANK YOU. NEXT WE'LL HAVE MR. DAVID BRUTON. HE IS APPLIED TO SERVE ON THE VETERANS LIAISON ON BOARD.
MR. WOOTEN, PLEASE TAKE A FEW MINUTES TO MAYOR.
YES? I JUST RECEIVED AN EMAIL A FEW MINUTES AGO THAT MR. WOOTEN WAS ON HIS WAY HERE, AND HE RECEIVED AN URGENT PHONE CALL WHERE HE HAD TO RETURN HOME FOR A CHILD SITUATION SO HE WOULD NOT BE WITH US THIS EVENING.
WE'VE HEARD FROM ONE APPLICANT FOR THE HISTORICAL COMMISSION.
WE'VE RECEIVED NO OTHER APPLICANTS.
DO YOU WISH TO TAKE ANY ACTION ON THIS TO THIS EVENING? MAYOR, WOULD WE LIKE TO GIVE OUR OTHER APPLICANT FOR THE VETERANS BOARD ANOTHER OPPORTUNITY.
I THINK SO. I WAS JUST TALKING ABOUT THE HISTORICAL COMMISSION.
SO I THINK, THE COUNCIL WOULD LIKE TO, PROVIDE MR. WOOTEN AN OPPORTUNITY TO RE-INTERVIEW ON THAT MAYBE AT THE NEXT MEETING OR WORK SESSION, IF THAT'S POSSIBLE.
JUST ONE NOTE ON THE, VETERANS LIAISON.
CAN WE LET, MR. TRAVIS KNOW THAT NO ACTION WAS TAKEN TONIGHT? BECAUSE I THINK HAD THE EXPECTATION HAD NO THIS WEEK.
THAT IS TRUE. CORRECT. I WOULD A GOOD POINT, BRIAN.
THANK YOU. I WILL FOLLOW UP WITH THEM FIRST THING.
I'M COMFORTABLE APPOINTING, MRS. SHAPLEY TO THE HISTORICAL COMMISSION.
IF THERE'S NO OBJECTION, I CAN MAKE A MOTION.
OKAY, COUNCIL. I'LL ENTERTAIN A MOTION.
FOR THIS, THE HISTORICAL COMMISSION.
I MOVED TO APPOINT DAWN SHAPLEY PLACE TWO.
SECOND. ANY DELIBERATION ON THAT MOTION? THERESA, WE HAVE A MOTION AND A SECOND.
APPOINTMENT OF MISS DAWN SHAPLEY TO OUR HISTORICAL COMMISSION PASSES BY UNANIMOUS VOTE.
[00:40:10]
MOVING ON TO ITEM K, THE TIME IS NOW 6:40 AND THE TOWN COUNCIL IS CONVENING INTO AN OPEN MEETING PURSUANT TO TEXAS GOVERNMENT CODE CHAPTER 551,[K. CLOSED MEETING]
SECTION 071, 072, 074 AND 087.WE'RE MOVING INTO A CLOSED MEETING.
ALL RIGHT. THE TIME IS NOW 8:10 AND THE TOWN COUNCIL IS RECONVENING INTO AN OPEN MEETING.
[L. RECONVENE]
THERE IS NO ACTION TO BE TAKEN AS A RESULT OF OUR CLOSED MEETING THIS EVENING.SO WE'LL BE MOVING ON TO ITEM M, CONSENT.
[M. CONSENT ITEM(S)]
DOES ANYONE WISH TO MOVE ANY OF OUR CONSENT ITEMS TO THE REGULAR AGENDA? IF NOT, I'LL ENTERTAIN A MOTION FOR ITEMS ONE THROUGH FOUR.I MOVE TO APPROVE CONSENT ITEMS M ONE THROUGH M FOUR AS PRESENTED.
SECOND. ANY DELIBERATION ON THAT MOTION? THERESA, WE HAVE A MOTION AND A SECOND.
MOVING ON TO LETTER N, REGULAR ITEMS, NUMBER ONE, MERCHANT CARD SERVICES.
[N.1. Merchant Card Services (Open Edge Pavments LLC) ]
STARTING US OFF TONIGHT IS A STAFF PRESENTATION BY MR. J.P. WALTON, OUR CHIEF STRATEGIC OFFICER.AS WELL AS MISS JULIE TAYLOR, DIRECTOR OF TREASURY OPS.
BUT I THINK SHE MAY HAVE LEFT.
THANK YOU VERY MUCH. I KIND OF ALLUDED TO THIS AT THE WORK SESSION ON THURSDAY.
I'M GOING TO GO AHEAD AND GO ON TO OUR NEXT SLIDE.
SO WHY ARE WE HERE TONIGHT? TOWN COUNCIL HAD SEVERAL QUESTIONS ABOUT, RISING CREDIT CARD FEES DURING THE FISCAL YEAR 23-24 BUDGET CYCLE.
REALLY, JULIE TAYLOR DID A LOT OF WORK.
OUR DIRECTOR OF TREASURY OF OPERATIONS.
SO THAT TAKES THE TOTAL CREDIT CARD FEES CHARGED TO THE TOWN.
AND THEN WE ALSO HAVE OUR CONVENIENCE FEE.
IT'S A $3 CONVENIENCE FEE, BUT THAT'S ONLY TOWARDS ONLINE PAYMENTS.
AND SO IN TOTAL, WE'RE RUNNING AROUND A 50% COST RECOVERY.
SO HOW DO WE IMPROVE THAT RECOVERY? YOU REALLY HAVE TWO OPTIONS.
CUT THE COSTS, INCREASE REVENUES.
IN THIS CASE, IT'S LOWER THOSE CREDIT CARD FEES AND OR INCREASE THE CONVENIENCE FEE.
SO WHAT'S BEFORE YOU TONIGHT? WE DID THAT FULL REVIEW.
I'M NOT GOING THROUGH THE FULL REVIEW TONIGHT BECAUSE WHAT IS ON THE AGENDA ARE THESE TWO, THESE TWO ITEMS, THE CLIENT SATISFACTION OFFER AND ALSO A UTILITY MERCHANT ADDENDUM AND QUESTIONNAIRE.
WE PLAN ON BRINGING THE FULL PICTURE TO YOU ON MARCH 21ST WORK SESSION.
BUT WE DIDN'T WANT TO HOLD THESE ITEMS BACK AS A PART OF THIS FULL REVIEW.
WE SAW AN OPPORTUNITY TO LOWER RATES.
WE DIDN'T WANT TO HOLD ON TO THAT SAVINGS.
SO THAT CLIENT SATISFACTION OFFER WOULD, LOWER OUR, OUR RATES.
AND SO THAT PART IS AN APPLICATION TO REVIEW.
AND THAT'S WHAT WE, NEEDED YOUR SIGNATURE FOR THE MAYOR'S SIGNATURE FOR.
SO WHEN WE TALK ABOUT MERCHANT CARD SERVICES, THERE ARE SEVERAL FEES THAT ARE INVOLVED.
SO THERE ARE INTERCHANGE FEES.
AND THESE COME FROM THE SPECIFIC CREDIT CARDS.
THAT'S GOING TO BE VISA, MASTERCARD, DISCOVER, AMEX.
AND THERE'S ALSO PROCESSING MARKUP FEES.
AND THAT REALLY COMES FROM YOUR PROCESSING PROVIDER.
IT'S A NICE LITTLE ILLUSTRATIONS HERE, ON TO THE RIGHT.
THOSE THREE DIFFERENT LAYERS BEING KIND OF ADDED ON TOP OF AND CHARGED, AS IT GETS TO THE MERCHANT.
I DON'T EXPECT YOU ALL TO BE ABLE TO READ THAT.
SO I JUST WANT TO GET AHEAD OF MYSELF HERE.
THESE ARE ALL THE FEES THAT WERE CHARGED.
AND SO.. FITTING THAT ALL ON THE SLIDE, JP, I APPRECIATE YOU.
I KNEW THAT YOU WOULDN'T BE ABLE TO READ IT, BUT AT THE SAME TIME, IT STILL HAS THE IMPACT THAT THERE ARE A LOT OF DIFFERENT FEES, THAT WE'RE TALKING ABOUT HERE. SO LET'S TRY TO GO THROUGH THIS.
AND, A LOT OF THIS DEPENDS ON WHAT TYPE OF CARD YOU'RE USING.
[00:45:07]
CARDS? THIS IS HOW THEY'RE PAYING FOR THAT ON THE BACK END.SO THAT'S WHY THERE'S A DIFFERENT FEE FOR EVERY SINGLE ONE OF THESE CREDIT CARDS.
AND SO THAT'S JUST AN EXAMPLE.
AND SO WHAT THE CLIENT SATISFACTION AGREEMENT.
SO THAT ONE, ONE OF THE TWO ITEMS THAT WE HAVE BEFORE YOU TONIGHT IS TO GO AHEAD AND LOWER THE, TO A DISCOUNT RATE OF 0.2% AND $0.10 PER ITEM. SO WHAT'S THAT IS REFERENCING HERE IS REALLY ALL OF THESE SEPARATE CREDIT CARD PAYMENTS DOWN TO AROUND RIGHT HERE. WE CAN GET THAT RATE AND THAT PER ITEM ON IT, WHICH IT CURRENTLY ISN'T, IS NOT THERE TODAY.
AND THEN WE HAVE THESE TWO OTHER FEES, THE SETTLEMENT FEE, FUNDING FEE AND THE RISK ASSESSMENT FEE.
THEY ACTUALLY LIVE RIGHT DOWN HERE.
THESE ARE WHERE OUR OVERALL FEES ARE DOWN HERE.
THESE TWO FEES, THE RISK ASSESSMENT FEE.
EXCUSE ME. JULIE REALLY SAW THIS FEE START TO INCREASE.
AROUND THE END OF 2021 WHEN INQUIRING ABOUT IT, IT WAS DUE TO WHAT THEY HAD SAID COVID.
AND OF COURSE, THEY PUSH IT ON TO THE, TO THE MERCHANT.
AND SO, AGAIN, THIS WOULD GET US A RATE OF 0.2% FOR EACH OF THESE ITEMS AND A PER ITEM, A POINT 10%.
NOW, WHEN WE ASKED GLOBAL PAYMENTS TO TAKE A DEEP DIVE, THEY DID A FULL ASSESSMENT ON NOVEMBER 2023.
AND THIS PARTICULAR MONTH, THEY ESTIMATED A SAVINGS OF $9,472.34.
THIS IS ESSENTIALLY AN APPLICATION.
SO WE CAN START THIS PROCESS ON OUR IN-PERSON FEES AND HOPEFULLY GET THOSE RATES LOWERED AS WELL.
SO. IT SOUNDS LIKE A LOT, BUT THIS PARTICULAR ITEM IS PRETTY SIMPLE.
THIS IS GOING TO BE NO COST TO THE TOWN.
WE ESTIMATE AROUND 100,000 IN ANNUAL SAVINGS.
AND WE DON'T KNOW ABOUT YOU KNOW, YOU NEVER KNOW WHAT'S IN THE FUTURE AND THOSE CHANGES.
SO WE WANT TO STAY ON TOP OF IT.
THERE'S MORE THINGS THAT WE NEED TO TALK ABOUT.
WE NEED TO TALK ABOUT THE $3 CONVENIENCE FEE FOR ONLINE PAYMENTS.
AND ALSO WE CURRENTLY DO NOT CHARGE THAT A FEE FOR THE OVER THE COUNTER TRANSACTION.
SO I WILL TELL YOU, THOUGH, 82% OF ALL OF OUR CREDIT CARD FEES AND ALL OF OUR REVENUES COMING IN FROM THIS ARE 82% COMES FROM UTILITY BILLING, ONLINE PAYMENTS.
SO THAT IS A BIGGEST CHUNK OF WHAT WE'RE LOOKING AT.
AND SO WHAT WE'RE BRINGING YOU TONIGHT WOULD ACTUALLY AFFECT THOSE COST ON THOSE, SO.
AND WE WANTED TO MAKE A POINT OF BRINGING IT UP TO YOU.
COUNCIL, DO YOU HAVE ANY QUESTIONS FOR STAFF? SO WHEN YOU'RE SAYING ONLINE PAYMENT, IS THAT BECAUSE I MEAN I THINK WHEN I SET UP MY BILL I WENT TO THE THE OFFICE AND SET UP AN AUTOMATIC TRANSACTION.
THAT IS PROBABLY ME USING THE WRONG TERMINOLOGY, ONLINE CREDIT CARD PAYMENT.
SO WHEN YOU MAKE AN ONLINE, ONE TIME CREDIT CARD PAYMENT, WE'RE GOING TO CHARGE THAT FEE.
IF YOU HAVE THAT SET UP THROUGH YOUR BANK, THIS IS NOT WHAT WE'RE TALKING ABOUT HERE.
GREAT. OKAY. SO RESIDENTS HAVE A WAY TO AVOID THESE CHARGES IF THEY WANT TO.
ALL RIGHT, I'LL ENTERTAIN A MOTION.
MOVED TO APPROVE ITEM N1 AS PRESENTED.
ANY DELIBERATION ON THAT MOTION? THERESA, WE HAVE A MOTION AND A SECOND.
ROLL CALL] ITEM N1, MERCHANT CARD SERVICES PASSES BY UNANIMOUS VOTE.
MOVING ON TO ITEMS TWO AND THREE WILL BE OPENING THEM CONCURRENTLY.
[Items N.2 & N.3]
THAT'S CON 23-0001 AND TRP23-0017.[00:50:03]
WOODS HERE. HE'S IN THE BACK IN CASE, YOU HAVE ANY QUESTIONS ON THE TREE REMOVAL PERMIT? GOOD EVENING LEXIN.GOOD EVENING, MAYOR AND COUNCIL.
AS MENTIONED, THIS IS A PROPOSED CONSERVATION DEVELOPMENT.
IT'S A HIGH END CONSERVATION, ALSO CALLED FM 1171.
AND I THINK THEY ARE ALSO NOW CONSIDERING THE NAME CROSS TIMBERS.
AS WELL AS AN ASSOCIATED TREE REMOVAL PERMIT.
HERE'S THE GENERAL LOCATION OF THE PROPERTY.
YOU CAN SEE THAT IT'S NORTH OF CROSS TIMBERS AND WEST OF MONTESINO AND ALSO PEPPER CREEK.
THE LAND USE FOR THIS PROPERTY IS RURAL, RESIDENTIAL, AND THE CROSS TIMBERS CONSERVATION DEVELOPMENT DISTRICT AND THE ZONING IS A PROPOSED ZONING IS PD 196 FOR AGRICULTURAL USES WITH CONSERVATION DEVELOPMENT.
IT'S CURRENTLY ZONED INTERIM HOLDING IN AG.
HERE'S THE OVERALL CONCEPT PLAN.
YOU CAN SEE THAT THERE'S A TOTAL OF 74 RESIDENTIAL LOTS PROPOSED.
THERE'S ALSO SEVEN, WELL, FIVE OPEN SPACE LOTS AND TWO X LOTS FOR A TOTAL OF SEVEN UNBUILDABLE LOTS.
THAT'S 81 LOTS IN ALL, 20 OF THE 74 RESIDENTIAL LOTS ARE GREATER THAN ONE ACRE.
SO THAT'S MEETING THE 25% REQUIRED FROM THE NEW CROSS TIMBERS REQUIREMENTS.
AGAIN, MEETING THOSE REQUIREMENTS FROM THE CROSS TIMBERS, THERE IS A GREATER THAN 45% OPEN SPACE.
SO MEETING THAT REQUIREMENT AS WELL.
WITH THAT ENHANCED NOTIFICATION PROCESS BACK IN MARCH, THEY HAD A P&Z WORK SESSION IN AUGUST, THE SECOND NEIGHBORHOOD MEETING THE LAST DAY OF AUGUST, AND P&Z PUBLIC HEARING NOVEMBER 13TH, AND THEN THE TOWN COUNCIL PUBLIC HEARING NOVEMBER 16TH.
AND SO THEY'RE HERE TO PRESENT THOSE TONIGHT.
SO AGAIN, LOOKING AT THE IMPACTS TO SLOPE THAT ARE GREATER THAN OR EQUAL TO 5% AND LESS THAN 12%, IT WENT FROM 61 ACRES TO CURRENTLY 50 ACRES AND IMPACTS THE SLOPE, THAT'S OVER 12% WENT FROM 6.64 ACRES TO THREE ACRES.
PERCENT OF LOTS THAT ARE GREATER THAN AN ACRE WENT FROM 37% TO 27%.
SO THE DIFFERENCE THERE IS SOME OF THAT LAND THAT WAS PREVIOUSLY WITHIN LOTS.
AND SO THEY PULLED IT OUT AND PUT IT INTO OPEN SPACE.
SO THE OPEN SPACE WENT UP AND THE NUMBER OF LOTS THAT WERE OVER ONE ACRE WENT DOWN.
BUT EVERYTHING'S STILL WITHIN THE REQUIREMENTS.
ORIGINALLY, THE APPLICANT WAS ASKING FOR 35% FOR ALL LOTS.
THEY'RE NOW ASKING FOR 25% FOR THE PRIMARY STRUCTURE FOR ALL LOTS AND 35% FOR THE PRIMARY, AND ACCESSORY STRUCTURES FOR LOTS THAT ARE LESS THAN AN ACRE. MODIFICATION TO SUBDIVISION SIGN STANDARDS.
ORIGINALLY THEY WERE ASKING FOR THAT MODIFICATION AND THEY ARE NO LONGER REQUESTING THAT.
BUT WE STAFF DID NOT HAVE A FINAL EXHIBIT AT THAT TIME, AND THEY STILL DON'T HAVE A FINAL EXHIBIT, BUT JUST UNDERSTANDING THE PARAMETERS, THEY FEEL LIKE THEY DO NOT NEED TO MODIFY THE SIGN STANDARDS.
THAT LANGUAGE IS STILL INCLUDED.
WE'VE ALSO ADDED SOME LANGUAGE BASED ON SOME FEEDBACK FROM A COUNCIL MEMBER, DURING THEIR KIND OF DISCUSSIONS WITH THE APPLICANT WHERE THEY TALKED ABOUT THE APPLICANT, TALKED ABOUT HOW THEIR GOAL WAS TO TERRACE RETAINING WALLS SO THAT THEY WOULD HAVE MORE SHORTER WALLS AS OPPOSED TO ONE REALLY TALL WALL.
AND SO THERE WAS A REQUEST TO INCORPORATE SOME LANGUAGE TO ADDRESS THAT.
SO, STAFF HAS ADDED SOME LANGUAGE.
THE RETAINING WALL SHALL BE TERRACED TO REDUCE IMPACTS UNLESS PRESERVING AN ENVIRONMENTAL FEATURE.
BUT WE STILL RETAINED THAT LANGUAGE ABOUT RETAINING WALLS GREATER THAN EIGHT FEET REQUIRE APPROVAL OF AN EXCEPTION, BECAUSE THAT CAME FROM THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION.
I DO THINK THE APPLICANT WANTS TO TALK TO YOU ABOUT THAT.
SO THERE ARE STILL THERE ARE STILL 18 TREES OF 135 TOTAL THAT BEER ARE BEING REQUESTED FOR REMOVAL.
[00:55:02]
AND ECC STILL RECOMMENDED APPROVAL OF 14 OF THE 18.SO THREE OF THE TREES CHANGED FROM ONE APPLICATION VERSION TO THE NEXT.
BUT THAT WAS THE REASON FOR THEM GOING BACK TO ECC.
SO HERE'S THE TOPOGRAPHIC SLOPE MAP JUST TO SHOW YOU WHAT WOULD BE IMPACTED.
IT'S KIND OF HARD TO IT'S A LITTLE HARD TO SEE.
BUT THESE ORANGE AREAS, THESE ARE ACTUALLY HATCHED.
SO THESE ARE THE 5 TO 12% IMPACTS.
THE AND THEN THE THE LIGHTER KIND OF YELLOWY ORANGE IS NOT IMPACTED IN 5 TO 12.
AND THE DARK RED THAT'S ACTUALLY HATCHING.
ANOTHER MODIFICATION THAT THE APPLICANT MADE WAS TO THE 200 FOOT SCENIC CORRIDOR SETBACK.
AND THE APPLICANT HAD SOME CONCERNS ABOUT JUST THEIR ENTRANCE AND WHERE THEY NEEDED TO LOCATE IT AND TRYING TO PRESERVE SOME OF THAT TOPOGRAPHY. AND SO BECAUSE OF THAT, THEY WERE ENCROACHING SOMEWHAT INTO THAT 200 FOOT SETBACK.
THIS WAS THEIR ORIGINAL REQUEST, AND THEY HAVE REDUCED THE AMOUNT OF IMPACT.
AND YOU CAN SEE IN THE CURRENT REVISED VERSION, SO WHERE IT'S ONLY THERE RIGHT AT THE ENTRANCE AND THEY'VE PULLED THIS PIECE THAT WAS FURTHER SOUTH, OUT OF THAT IMPACT AREA.
THIS IS JUST TO DISCUSS THE DIMENSIONAL REGULATIONS, WHAT'S CURRENT AND WHAT'S PROPOSED.
SO WITH A TYPICAL AGRICULTURAL ZONING, IT'S NOT PART OF A CONSERVATION DEVELOPMENT.
MINIMUM LOT AREA WOULD BE TWO ACRES AS PROPOSED.
THE MINIMUM LOT SIZE IS THREE QUARTERS OF AN ACRE.
MINIMUM LOT WIDTH AND AG WOULD BE 200FT.
AND SO THAT IS THE STANDARD FOR THE CONSERVATION DISTRICTS AND THAT'S WHAT'S PROPOSED HERE.
MINIMUM FLOOR AREA IN AG IS 1800 SQUARE FEET.
THEY'RE PROPOSING 2100 KEEPING THE SAME FRONT SETBACK.
MINIMUM SIDE YARD SETBACK IS 25FT IN AG.
THEY'RE PROPOSING 25FT FOR MOST, BUT 20FT FOR THESE SEVEN LOTS THAT ARE REQUESTING SIDE SETBACK MODIFICATIONS. AND THEN REAR YARD IS STAYING 20FT.
AND WE ALREADY TALKED ABOUT THE MAXIMUM LOT COVERAGE CHANGE.
JUST A COUPLE OF PICTURES OF THE OVERALL AREA.
SO HERE'S THE CONCEPT PLAN BUT A FEW OF THESE.
SO IT JUST GIVES YOU A MORE DETAILED LOOK AND BROKEN INTO SECTIONS.
THIS IS COMING UP. CROSS TIMBERS.
AND YOU CAN SEE THIS IS TO THE EAST WHERE THE WHERE THE DEVELOPMENT STARTS.
SO AGAIN, THEY SOMEWHAT CHANGED THIS DESIGN OF THIS AREA.
I KNOW ONE OF THE OTHER THINGS COUNCIL HAD TALKED ABOUT WAS KIND OF THEIR CONCERN OF THE VIEW AS YOU WERE COMING UP CROSS TIMBERS AND WHAT YOU WOULD SEE AS FAR AS PEOPLE'S BACK OR BACKYARDS AND THAT SORT OF THING.
AND SO THEY'VE TRIED TO REDUCE THAT VIEW.
SO YOU SEE MORE, OPEN SPACE AREA INSTEAD.
THERE'S ANOTHER VIEW AGAIN, THIS THIS MAIN AREA.
THIS IS WHERE THE HIGHEST SLOPES ARE.
AND THOSE ARE BEING PRESERVED WITH SOME TRAILS WITHIN.
THEY ARE PROPOSING ALSO A PLAYGROUND THAT IS NOT PART OF THE THE OPEN SPACE.
THE MAJORITY OF THIS AREA IS OPEN SPACE.
SO THEY ARE PROPOSING TO PLANT THE REQUIRED LANDSCAPE BUFFER ALONG CROSS TIMBERS.
AND SEE THE EXISTING TREES THROUGHOUT THE DEVELOPMENT.
THOSE ARE HEAVILY TREED AREAS THAT WILL PRIMARILY REMAIN UNDISTURBED WILDLIFE CORRIDORS.
ORANGE IS NOT ON THIS PLAN, BUT THAT'S ZONE B NATIVE OPEN SPACE.
[01:00:01]
SO NOT SO HEAVILY TREED STILL PRIMARILY, JUST NATIVE UNDISTURBED AREA.ZONE C IS TRANSITION OPEN SPACE.
IT'S GOING TO BE MORE MANICURED BECAUSE IT'S ADJACENT TO TRAILS OR ROADWAYS, THAT SORT OF THING.
SO IT'LL ACTUALLY BE MAINTAINED.
THE TRANSITION OPEN SPACE I THINK IS, JUST MAINTAINED QUARTERLY.
SO THIS SHOWS YOU AGAIN THE AGAIN, THE ORANGE SPACES WERE THE AREAS THAT WERE NOT AS HEAVILY WOODED, BUT STILL INTENDED TO BE PRIMARILY NATIVE AND UNDISTURBED. HERE IS THE TREE SURVEY.
SO AS MENTIONED THERE ARE 135 TOTAL SPECIMEN TREES ON THE SITE.
YOU CAN SEE ALL OF THE, THE GREEN CIRCLES ARE THOSE SPECIMEN TREES THAT ARE BEING PRESERVED.
RED ARE THE ONES THAT ARE BEING REQUESTED TO BE REMOVED.
AND THEN THESE ORANGE PLACES OR TREES THAT, WERE REQUESTED TO BE REMOVED.
BUT THAT ECC RECOMMENDED DENIAL OF AND THE APPLICANT CAN SPEAK MORE TO THIS.
I BELIEVE MY UNDERSTANDING IS THAT IT IS THEIR INTENTION TO TRY TO PRESERVE THE TREES THAT ECC RECOMMENDED DENIAL OF, BUT IT IS STAFF'S BELIEF THAT IT IS UNLIKELY THAT THEY WILL SURVIVE.
AND SO WE WOULD RECOMMEND, IF THE PROJECT WAS TO BE DEVELOPED AS PROPOSED, THAT THOSE SPECIMEN TREE PERMITS BE APPROVED FOR REMOVAL.
SO THAT THE DEVELOPER IS NOT UNDULY PENALIZED BECAUSE WE DON'T THINK THEY'RE GOING TO SURVIVE.
THAT MAKES SENSE. SO THEY DON'T SURVIVE AFTER THE FACT, WE DON'T GET ANYTHING OUT OF IT.
SO THERE ARE, THERE ARE TWO RIGHT HERE.
AND THEN THERE'S ANOTHER ONE HERE ON THE REAR OF THE PROPERTY LINE.
AND THEN THIS IS THE FOURTH ONE.
WHAT WAS THE TOTAL NUMBER OF SPECIMEN TREES AGAIN? 135. SO AGAIN, THAT'S JUST A SUMMARY OF THE TWO ECC MEETINGS.
THE REASON THE SECOND MEETING WAS NECESSARY, BUT I THINK WE'VE ALREADY COVERED THAT.
LEXIN DO YOU HAVE THE DESIGNATIONS OF THOSE TREES, THE NUMBERS, SO THAT IF WE NEED TO MAKE A MOTION FOR SOME OR NOT THE OTHER, WE CAN MAKE THAT? I KNOW THAT ONE'S 1300.
THAT WAS THE ONE FROM THE LAST MEETING.
I MIGHT CALL MATT WOODS UP HERE 1274, 1275 OR 1275.
AND I DON'T REMEMBER THAT ONE 600 SOMETHING.
OKAY. SO I JUST DID SOME QUICK MATH.
SO 18 JUST SO YOU GUYS KNOW IS 13%.
THE TREE NUMBERS THAT WERE DENIED ARE 632, 1274, 1275, AND 1300.
SO WHICH ONE IS THE ONE THAT'S ON THE PROPERTY LINE? WAS THAT 13 OR 6, 32 1300.
BUT THEN OKAY, WAIT, WHERE TO GO? 1300 NORTH.
THIS ONE'S ON THE OTHER SIDE OF THE PROPERTY LINE, CLOSER TO THE STREET.
SO IN THE RIGHT OF WAY? NO, I DON'T THINK IT'S IN THE RIGHT.
I THINK IT'S WITHIN THE PROPERTY.
PART OF THE CHALLENGE IS WITH THOSE THEY'RE IN THE EASEMENTS.
OKAY. SO THERE WILL BE GRADING WHETHER IT'S DRAINAGE OR UTILITY WORK OKAY.
SO OKAY, THAT'S WHY THEY'RE COMING FOR YOU.
SO YOU SAID THIS IS IN AN EASEMENT.
IS THAT SO? I SEE THE, THE BUILDABLE AREA AND I SEE THESE DASHED LINES CLOSER TO THE STREET.
IS THAT THE PORTION OF IT THAT YOU'RE SAYING IS THE EASEMENT, DRAINAGE AND UTILITY EASEMENT.
OKAY. SO THE SO YOU HAVE THE, THE CURB, THEN YOU HAVE TWO EASEMENTS, A DRAINAGE AND A UTILITY.
YEAH. WITHOUT. YEAH, I BELIEVE I BELIEVE THAT'S CORRECT THOUGH.
BUT IF YOU. POTENTIALLY YOU STILL HAVE THE OVERHANG WITH THE DRIP LINE, THE ROOT ZONE.
IT'S NOT JUST THE TRUNK, OBVIOUSLY, IT'S THE CANOPY SPREAD THAT COULD HELP SOME.
I JUST DON'T KNOW HOW FAR YOU'D HAVE TO MOVE IT OVER TO GET OUT OF THE CRITICAL ROOT ZONE.
OKAY. AND IN GRADING TO MAKE IT SLOPE SO IT DRAINS PROPERLY.
[01:05:01]
AND IF YOU MOVED IT THE ROAD WEST, YOU COULD LOSE THE ONE ON THE OPPOSITE SIDE OF THE STREET.FEEL LIKE YOU COULD CURVE THE ONE NORTH, TO THE NORTH, TO THE NORTHWEST.
THAT GREEN TREE ON LOT 20, OR IS THAT FOR THAT ONE? IF THE ROADWAY SHIFTED WEST, YOU JUST WANT IT.
I MEAN, YOU'VE GOT YOU'VE GOT OPEN SPACE HERE IMMEDIATELY TO THE WEST.
YOU'VE GOT OPEN SPACE HERE IMMEDIATELY TO THE SOUTH.
SO THERE'S PLENTY OF ROOM TO RECONFIGURE THE LOT.
AND IF THE ROAD WERE JUST KIND OF STRAIGHTENED OUT THERE, IT SEEMS LIKE THAT WOULD PULL.
NOT SHIFTING IT MORE, STRAIGHTENING IT DOWN.
YEAH. JUST I'M JUST LOOKING AT THERE.
AT THIS POINT IN THE PROJECT, WE HAVEN'T BROKEN ANY GROUND YET.
CAN YOU TALK ABOUT 632 AND WHY THAT ONE IS DESIGNATED FOR REMOVAL? THEY WERE ACTUALLY GOING TO SAVE THAT TREE.
IT WAS JUST POTENTIAL FUTURE WORK IN THE EASEMENT.
BUT THEY DID COMMIT TO SAVING THAT TREE.
IS THERE DRAINAGE? WHAT WAS, IT'S SAME.
I BELIEVE IT'S A DRAINAGE AND UTILITY EASEMENT.
THAT MAYBE THAT ONE MAYBE DESIGNATED MORE FOR DRAINAGE, I BELIEVE.
YEAH, BUT I THOUGHT WE CAN'T DRAIN LOT TO LOT.
THAT HAS TO COME TO THE FRONT.
RIGHT. THAT'S AN X LOT WHERE IT MAY BE TAKING IT TO THE WEST.
I'M NOT POSITIVE THE APPLICANT MAY KNOW THE DETAILS ON HOW THAT LOT DRAINS.
WHAT WAS THE ECC? WHAT WAS THEIR RATIONALE FOR DENYING THAT? THAT WAS DUE TO THE OCTOBER RECOMMENDATION OF DENIAL WHEN THE LOTS SWITCHED.
I THINK THOSE JUST ENDED UP IN A A SPOT WHERE, THEY PROBABLY COULD HAVE TAKEN ANOTHER RECOMMENDATION AT IT, BUT I BELIEVE, OKAY, IF WE DID, AGAIN, ANOTHER BITE AT THE APPLE, THEY MAY HAVE RECOMMENDED ANOTHER.
AND THEN FOR THE PARKS BOARD RECOMMENDATION, THE PARKS BOARD VOTED UNANIMOUSLY TO RECOMMEND CASH IN LIEU OF LAND TO SATISFY THE PARKLAND DEDICATION AND THE AMOUNT OF 124,003 20, AND PARK DEVELOPMENT FEES OF 102,712.
SO HERE AGAIN IS THE OVERALL CONCEPT PLAN.
I'D BE HAPPY TO ANSWER ANY OTHER QUESTIONS.
THE APPLICANT I KNOW ALSO HAS A PRESENTATION.
GO AHEAD. SORRY MAYOR. COUNCIL, DO YOU HAVE ANY QUESTIONS? LEXIN ON SLIDE SEVEN, YOU TALKED ABOUT LOT COVERAGE 25% FOR SMALLER LOTS, THE ACCESSORY STRUCTURES EXTENDING THAT TO 35%.
WHAT KIND OF STRUCTURES WOULD BE ALLOWED WITH THAT? 25 TO 35%.
SO ANY ACCESSORY STRUCTURE THAT THEY WANTED TO PUT IN.
NO, I THINK I UNDERSTAND. I JUST WANT TO MAKE SURE.
SO IT'S LIKE A POOL CABANA, A CARPORT, A DETACHED GARAGE, A POOL HOUSE KIND OF THING.
OKAY. YES. ANY ANY TYPE OF ACCESSORY STRUCTURE THAT WOULD BE ALLOWED WITHIN THE TOWN.
OKAY. DRIVEWAY COUNTS FOR THAT TOO.
FLAT WORK TOWARD LOT COVERAGE.
WE'LL BRING UP THE APPLICANT FOR A PRESENTATION.
WE ALSO HAVE RANDY AND JAMESON WITH US TONIGHT.
AND RANDY RIVERA, LAND PLANNER, MCADAMS, 4400 STATE HIGHWAY 121.
WE PROBABLY WILL RUN THROUGH IT A LITTLE BIT QUICKER.
AND THEN PATRICIA FANT, WHO DID A LOT OF THE LEGWORK, PULLED THIS TOGETHER, TOO.
VERY EXCITED TO SHOW YOU THE CHANGES.
DUSTIN DAVIDSON FROM HANES IS ALSO OUR CLIENT.
I'M NOT SURE, BUT I'LL BE TEXTING HIM THROUGHOUT THE NIGHT.
SO YOU MAY NOTICE A DIFFERENT VISUAL HERE FOR THE ENTRANCE.
[01:10:01]
WE SPENT A LOT OF TIME IN NOVEMBER TALKING ABOUT THIS MORE, MORE SUBURBAN, FORMAL, MONUMENTAL DESIGN.AND WE ARE SO HAPPY TO SHARE WITH YOU THE VISION THAT IS IN KEEPING WITH THE CROSS TIMBERS GOAL, AND VERY MUCH EVOKES THE SPIRIT AND INTENT OF THIS RURAL CHARACTER AS YOU COME INTO THE WESTERN PART OF THE CROSS TIMBERS.
AND YES, WE ARE WOULD LIKE TO NAME THE PROPERTY OR THE PROJECT CROSS TIMBERS.
YOU KNOW, IT'S A IT'S A VERY UNIQUE, ONE OF THE MOST UNIQUE SITES THAT WE HAVE IN THE TOWN.
SO STARTING THERE AND, I ALSO WANT TO, AS WE GO THROUGH THIS AND TALK ABOUT THE CHANGES THAT HAVE HAPPENED SINCE NOVEMBER, I WANTED TO THANK YOU ALL FOR THE INPUT THAT YOU GAVE AT THAT MEETING.
I KNOW THERE WAS SOME BACK AND FORTH.
AND THEN WE WERE ABLE TO HAVE SOME MORE COLLABORATION IN THE LAST TWO MONTHS THAT REALLY HELPED INFORM THIS PLAN, TO EMBODY THE VALUES THAT ARE EXPECTED. WE'RE HOPING THAT THIS REALLY DOES SET THE BAR FOR THE NEW, CONSERVATION DEVELOPMENTS IN THE TOWN OF FLOWER MOUND.
SO I DO THINK IT'S ROUGHLY MAYBE 10% OF THE PLAN OR MORE.
AND YES, WE TOOK, SQUARE FOOTAGE OUT OF THE OVERSIZE LOTS, PUT IT INTO THE OPEN SPACE SO THAT WE COULD PRESERVE MORE OPEN SPACE AND STRATEGICALLY LOCATED OPEN SPACE THAT HAD STEEP SLOPES IN THOSE AREAS.
AND ONE OF THEM BEING THIS BUFFER, THE 200 FOOT SCENIC BUFFER.
IT WAS, A GOOD COMMENT AND INPUT TO WORK THROUGH THE ROAD THAT WAS THERE PREVIOUSLY.
SO WE WERE ABLE TO PULL OUT ABOUT 455FT OF STREET THERE THAT WOULD HAVE OTHERWISE BEEN WITHIN 200FT TO 1171. AND THEN I WOULD LIKE TO BRING UP JAMESON TO TOUCH BRIEFLY ON THE TREES AND PROBABLY ANSWER SOME OF THE QUESTIONS THAT WERE BROUGHT UP JUST A BIT AGO.
GOOD EVENING, JAMISON PENSON WITH MCADAMS. SO AS LEXIN WAS STATING, THERE'S, 135 TOTAL SPECIMEN TREES, WE'RE STILL REQUESTING, THE REMOVAL OF 18.
SO THAT'S PRESERVING 117 WITH A 87% PERCENT PRESERVATION RATE.
SO IN THAT TOP CIRCLE WE'VE BASICALLY FLIP FLOPPED.
WHICH TREE IS GOING TO BE PRESERVED, ON EITHER SIDE OF THE ROAD.
AND WE DO HAVE NOTES, ON OUR ZONING SPECIMEN TREE PLAN TO BORE THE FRANCHISE UTILITIES.
BUT IN CASE THOSE THINGS AREN'T SUCCESSFUL OR THEY AREN'T NECESSARILY ABLE TO, MANAGE THAT OR REQUEST REMOVAL AHEAD OF TIME, DOWN IN THE SECOND CIRCLE, THAT USED TO BE A PRESERVED TREE.
NOW IT'S BEING REMOVED BECAUSE THE BUILDING PAD AND THE PROXIMITY THERE, AFTER SOME FURTHER, LOOKING INTO THAT WITH OUR SCHEMATIC GRADING, WE'RE FINDING THAT THAT TREE IS GOING TO NEED TO BE REMOVED.
THE THIRD CIRCLE DOWN ON THE BOTTOM LEFT, THAT USED TO BE WHERE THERE WAS A LOT LOCATED.
SO GAINING THAT TREE BACK AND THEN IN THE BOTTOM RIGHT HAND CIRCLE, JUST A FLIP FLOP OF THE TWO TREES AS WE HAVE SOME RECONFIGURATION OF THE LOTS WITH THE NEW PLAN. SO THIS SLIDE IS GOING INTO THE THE RECOMMENDATION FROM EC ON
[01:15:07]
FOR THE TREES, TO BE RECOMMENDED FOR DENIAL.AND TREE 1300 UP AT THE NORTH.
THAT WAS AT THE ADVISEMENT FROM ENVIRONMENTAL STAFF THAT WE SHOULD GO AHEAD AND ASK FOR THE REMOVAL OF THAT TREE WITH ITS OVERHANG OF THAT TEN FOOT UTILITY EASEMENT.
WE DO PLAN TO MAKE EVERY EFFORT TO SAVE THAT.
BUT IN THE EVENT THAT IT'S NOT SUCCESSFUL, WE'RE ASKING, APPROVAL THERE, FOR REMOVAL.
THAT ONE'S RIGHT ON THE THE LOT LINE.
AND IF THEY EVER NEED TO COME IN AND MAKE ANY GRADING ADJUSTMENTS OR UTILITY WORK THROUGH THERE, THAT TREE COULD BE HAVE A SIGNIFICANT IMPACT TO THE ROOT ZONE. SO, TO START OFF, THOUGH, WE ARE GOING TO MAKE SURE THAT WE'RE ATTEMPTING TO SAVE THAT, BUT DO NEED A REQUEST, REMOVAL AT THIS TIME AS A PRECAUTION. AND THEN THE TREES, NUMBER 1274 AND 1275, THAT CAME FROM THE FIRST, THE FIRST PLAN THAT YOU SAW BEFORE, THESE USED TO BE LOCATED, ON THE SIDE OF THE LOT LINE.
AND WE DID HAVE TO, TURN THOSE TO REMOVED, AND CONTINUE TO ASK, TO REMOVE THOSE.
BUT NOW THEY'RE RIGHT IN THE CENTER OF WHERE THE BUILDING PAD IS GOING TO BE.
SO THOSE WILL DEFINITELY NEED TO COME OUT AT THIS TIME.
JAMISON, WOULD YOU MIND GOING BACK TO TREE 1300 TO THE NORTH SIDE AND OFFER YOUR OPINION ON WHAT COUNCIL MEMBER SCHIESTEL WAS SAYING ABOUT STRAIGHTENING OUT THAT ROAD TO POTENTIALLY SAVE THAT TREE? SO WE DID MAKE AN ADJUSTMENT TO THIS ROAD, EARLIER ON BETWEEN THE TWO REVISIONS.
MAYBE IT HAPPENED, JUST PREVIOUS TO THE SET, BUT WE DID MAKE ONE REVISION TO THIS ROAD.
SO THIS IS A BARDIC ROAD SECTION.
SO THERE'S A 17 FOOT PUD EASEMENT ON EITHER SIDE OF THE ROAD.
THAT'S WHERE THE BARDIC WILL OCCUR.
SO WE'RE TRYING TO STAY, A LITTLE FURTHER EAST TO GIVE THAT SOME CUSHION.
OKAY. OKAY IMPACT SLOPES GREATER THAN 12%.
THERE COULD STILL BE SOME SLOPES THAT COULD STILL OCCUR ON THE LOT THAT MAINTAIN THE SLOPE.
BUT FOR NOW, WE'RE PRESUMING THAT, YOU KNOW, IT'S ON THE LOT THAT, WE'RE LOOKING AT IT BEING GONE.
SO RIGHT NOW WE'RE LOOKING AT, THE AREAS IN PURPLE, THOSE ARE SHOWING THE IMPACTS.
AND YOU CAN REALLY START TO SEE WITHIN THE RED BOXES WHERE A LOT OF THOSE ADJUSTMENTS MADE.
SO UP ON THE TOP SIDE, THE FIRST BOX, REALLY LOOKING AT THE RECONFIGURATION OF WHAT WAS LOT 13 AND TAKING THAT OUT AND RECONFIGURING THAT.
SO WE PUSHED A LOT OF THAT, 12% OR GREATER SLOPE INTO THE OPEN SPACE, THE SAME ONE DOWN TO THE LEFT.
THAT WAS THE LOT SEVEN, WHICH ACTUALLY ALLOWED US TO SAVE ONE OF THE SPECIMEN TREES THERE, AS WELL AS REMOVE A SIGNIFICANT PORTION OF STEEP SLOPES THAT HAPPENED, ON THAT LOT, LOT SIX DOWN IN THE BOTTOM RIGHT.
THAT'S WHERE LOT SIX WAS, HAD A PRETTY SIGNIFICANT IMPACT THERE.
AND THEN AGAIN, DOWN AT THE FAR SOUTH, LOT ONE, THERE IS A CONSIDERATION ABOUT WHAT WAS THE BACK OF THAT HOUSE GOING TO LOOK LIKE AND HAVE A RETAINING WALL WITH, AN OPTIONAL FENCE THERE THAT MAY NOT HAVE LOOKED AS SIGHTLY THERE.
SO WE'VE AND RECONFIGURED THOSE SO THAT THE FRONT OF THE HOUSES ARE FACING 1171 AND EVEN THE SIDE OF THAT'S REALLY, BLOCKED MOSTLY BY A LOT OF NATIVE VEGETATION THERE.
AND SO WE ALSO LIMITED THE IMPACT, THERE ON LOT LOT ONE.
[01:20:08]
RANDY WAS TALKING ABOUT THE SLOPES ON THE SITE BEING A CHALLENGE.BUT HERE, THE BOTTOM BOLD LANGUAGE.
THIS IS, THE RECOMMENDATION MADE FROM PNC WAS JUST TO LIMIT THE THE HEIGHT OF THE WALL TO EIGHT FEET AND THEN TALKING THROUGH, SOME OF THE MEETINGS WITH THE INDIVIDUAL FEEDBACK FROM YOU GUYS, TERRACING WAS ONE OF THE THINGS THAT WE TALKED ABOUT TO KIND OF EASE THE APPEARANCE OF A LARGER RETAINING WALLS AND ALSO TO LIMIT, WHEN WE DO NEED TO, HAVE A RETAINING WALL OF EIGHT FEET OR HIGHER.
SO THAT WAS A LITTLE BIT VAGUE BECAUSE WE DIDN'T NECESSARILY WANT TO ALWAYS TERRORISTS LIKE, SAY, IF IT WAS A TWO FOOT WALL AND A TWO FOOT WALL, ONE FOUR FOOT WALL IS THE BEST SOLUTION IN MOST CASES.
SO WE WANTED TO KIND OF RELOOK AT THAT LANGUAGE AND, AND THEN ALSO ASK THAT STAFF BE ABLE TO REVIEW AND MAKE THE APPROVAL OF ANY INSTANCES WHERE A EIGHT FOOT WALL MAY NEED TO BE MADE, AND THAT THE ONLY TIME THAT A WALL EIGHT FEET OR LARGER SHOULD BE USED IS IN THE INSTANCE OF PRESERVATION.
SO THIS IS WHAT THIS LANGUAGE IS REALLY TALKING ABOUT.
AND I THINK KEEPS TRUE WITH WHAT THE ORDINANCE IS TALKING ABOUT.
AND USING THE RETAINING WALLS AS A BEST MANAGEMENT PRACTICE TO TRANSITION THE GRADES EFFECTIVELY AND MAKE SURE THAT WE'RE PRESERVING STEEP SLOPES, ENVIRONMENTAL SENSITIVE AREAS, EXISTING TREES AND SO ON AND SO FORTH.
SO, THE EIGHT FOOT WALL, THAT WAS DISCOURAGED IS REALLY AS A SCRAPE AND BUILD CONCEPT THAT NOT JUST A LEVEL OFF THE TOP OF A HILL AND, AND HAVE A LARGE EXPANSE OF GRADE THAT'S PRETTY MUCH FLAT AND THEN JUST TAKE OFF A EIGHT FOOT WALL THERE AT THE END. SO THIS IS REALLY DIRECTING THAT, THAT WE USE WALLS FOR THEIR CORRECT INTENTIONS AND THAT STAFF BE ABLE TO REVIEW AND GRADE US TO SEE.
YES. ARE YOU USING IT FOR THE RIGHT REASONS? AND IF SO, THEY COULD HAVE THE THE APPROVAL AUTHORITY THERE.
SO THE TOP SECTION CUT IS SHOWING WHERE TERRACED WALLS WOULD, BE HAPPENING WHEN THERE'S AN ADJACENT LOT OR OPEN SPACE THAT DOESN'T NECESSARILY HAVE A PRESERVATION ASPECT TO THAT, THAT THAT WOULD BE SOMEWHERE WHERE WE COULD DEFINITELY USE TERRACED WALLS AND SOFTEN THE, THE EFFECTS OF WHAT THAT SHEAR WALL MAY OCCUR.
BUT THEN WHEN SITE CONSTRAINTS ARE GETTING PRETTY TIGHT AND, WE'RE A LITTLE BIT MORE CONFINED ON HOW MUCH ROOM WE HAVE, AND THEN THERE'S SOMETHING THERE THAT WE'RE ACTUALLY TRYING TO PRESERVE, THEN, YES, EIGHT FOOT RETAINING WALL, WOULD BE THE PROPER TECHNIQUE IN ORDER TO PRESERVE THAT ZONE.
SO THIS IS JUST A DEPICTION OF WHAT WHAT THAT LANGUAGE WAS TRYING TO SAY.
SO WE'VE COME BACK AND REWORK THE ENTRY SIGN.
LOOKING AT MONOLITH, STONE BOULDER SIGNAGE AND MAYBE DOING SOME ENGRAVING ON THAT JUST TO GO AHEAD AND STEER CLEAR FROM, THE METAL. WE DON'T KNOW AT THIS TIME.
BUT THE CROSS TIMBERS NAME THAT YOU'LL SEE, THERE IS KIND OF DISPLAYED ALONG WITH, SOME OF THE LOGO OPTIONS THAT MATCHBOX, PREPARED THAT WE KIND OF SHOWED IN SOME OF THOSE PRESENTATIONS TO YOU LAST TIME.
SO THIS IS THE NEW THING IS TRYING TO LET THE LANDSCAPE KIND OF SPEAK MORE OF, TO THE ENTRANCE AND HAVE A MORE SUBTLE APPROACH ON THE ACTUAL SIGNAGE ITSELF.
SO, REALLY TRYING TO COME BACK WITH, MORE OF THAT NATIVE LOOK, THE ROLLING HILLS AND ESCARPMENTS THAT YOU MIGHT SEE IN NATURE THAT ARE STARTING TO BUILD UP TO THE THE FOOTHILLS OF A LARGER SYSTEM.
SO KIND OF MIMICKING THAT ON A SMALLER SCALE.
[01:25:09]
BACK ON THE BACK SIDE OF THE, THE LANDSCAPE REQUIREMENT AND THE SPLIT RAIL FENCE.AND THEN THERE'S TWO DIFFERENT SIGNS FOR THE EAST AND WEST TRAFFIC FOR THE CROSS TIMBERS.
AND THEN AS YOU MAKE YOUR DRIVE UP, THERE'S, THE LOGO OR THE BRAND FOR THE CROSS TIMBERS DEVELOPMENT THERE AT THE TOP OF THE HILL, AND THEN HAVING THE TERRACE RETAINING WALL TO HOLD BACK THAT THAT AREA AT 12% SLOPES AND THEN HELP KIND OF REESTABLISH WHERE THAT WASHOUT IS ON THE HILL. HERE, YOU CAN KIND OF SEE HOW THE ROLLING HILLS AND THE BERMS, THAT PARALLEL PARKWAY THAT'S KIND OF RUNNING UP ON THE NEXT TERRACE OF THE HILL IS GOING TO KIND OF ALL BUT DISAPPEAR AS YOU'RE LOOKING UP.
YOU CAN KIND OF SEE IT HERE AS WELL, BUT A FEW SHOTS OF THE ENTRANCE.
WHERE IT IS AND WE'LL OPEN IT UP FOR QUESTIONS.
I HAD A QUESTION ON THE LANDSCAPING ALONG 1171, THE TRANSITIONS FROM THE NATURAL AND MANICURED.
HOW IS THAT GOING TO BE? IT LOOKED LIKE KIND OF LIKE HARD CUTS WHEN IN LEXIN SLIDE.
IS IT GOING TO BE MORE TRANSITIONS? I MEAN, THE PICTURES KIND OF LOOK LIKE MOST OF ITS NATURAL LANDSCAPING.
AND THIS IS THE SAME PLACEMENT OF THAT WALL, BUT IT'S JUST SOFTENED UP WITH THE LANDSCAPE.
IS THAT WHERE YOU'RE REFERRING TO THE THE WALL ALONG IT WAS ON LEXIN SLIDE.
YEAH. I FEEL LIKE A LOT OF THE TIME WHEN I'M DRIVING ALONG, I'M 71.
YOU CAN SEE SOME HARSH TRANSITIONS BETWEEN MANICURED AND.
YEAH. HERE WE HAVE THE ZONE D'S THAT ARE KIND OF TRANSITIONING FROM THE ZONE A'S.
HOW IS THAT GOING TO WORK? BECAUSE THE PICTURE IS KIND OF I DON'T THINK THEY QUITE SHOW THAT.
OKAY, SO THE ESTATE OPEN SPACE, HERE, WHICH IS JUST ALLOWING FOR MORE MAINTENANCE.
I GUESS THERE COULD BE A BETTER BLEND BETWEEN THE PURPLE AND THE GREEN THROUGH SOME OF THIS ZONE, BECAUSE SOME OF IT'S GOING TO BE MADE OF MAYBE, NATIVE WILDFLOWER SEED MIXES ON TOP OF THE BERMS AND THINGS OF THAT NATURE, WHICH THOSE WON'T TAKE A LOT OF MAINTENANCE, PROBABLY LIKE BIANNUAL, TYPE MAINTENANCE, WHICH IS KIND OF A LITTLE BIT MORE WHAT THE PURPLE IS. BUT WHAT THE GREEN IS JUST SAYING IS THAT REGULAR MAINTENANCE CAN OCCUR IN THAT ZONE, WHETHER IT BE GOING IN AND WEEDING, WHETHER IT BE GOING IN AND PLANTING NEW PLANT MATERIAL THAT MAY HAVE DIED OUT.
THERE'LL BE SOME SEASONAL COLOR THAT COMES BACK IN THROUGH THIS ZONE, THAT THEY'LL COME PLANT FOR THE ENTRY FEATURE SO THAT YOU GET POPS OF COLOR THROUGH THE SPRING OR THROUGH THE FALL.
SO IT'S JUST A MAINTENANCE ZONE THAT ALLOWS THEM TO COME IN AND MAINTAIN ON A REGULAR BASIS..
IT WON'T NECESSARILY BE MOWED.
YEAH. ANY OTHER QUESTIONS FOR THE APPLICANT? I HAD ONE OTHER QUESTION ON THE THE 25% LOT COVERAGE.
SO ON ONE ELECTION SLIDES, IT SHOWED 25, 27% WOULD BE IMPACTED BY THE 25% LOT COVERAGE.
SO IT'S ONLY ONE IN EVERY FOUR LOTS.
WAS KIND OF IN THAT SUMMARY OF THE CHANGES.
WHICH ONE WAS THAT LEXIN? 74. I THINK IT'S THE THE SLIDE SEVEN.
THIS NUMBER HERE IS THE NUMBER OF LOTS THAT ARE GREATER THAN ONE ACRE.
YEAH. SO THAT THOSE LOTS WOULD BE LIMITED TO THE 25%.
OKAY. THE ONLY TIME THE 35% WOULD KICK IN IS IF IT'S ACCESSORY STRUCTURE.
[01:30:02]
YES. OKAY. ALL RIGHT.I'M ALL RIGHT. MATT, I HAD A QUESTION ABOUT THAT TREE.
632 THAT WAS IN THE TOWN'S EASEMENT.
SO THE APPLICANT MENTIONED THAT IF THE TOWN REQUIRED SOME GRADING OR SOMETHING, AND THAT MAY RESULT IN THE REMOVAL OF THE TREE, IF THAT WERE THE CASE, WOULDN'T WE JUST REMOVE IT? DO WE NEED TO APPROVE A TREE REMOVAL NOW IN CASE THE TOWN HAS A NEED FOR THAT? WELL, IT'S NOT IN A PLATTED EASEMENT YET.
ONCE YOU PLANTED A TREE IN AN EASEMENT, THEN IT BECOMES EXEMPT, WHETHER IT'S TOWN OR OTHERWISE.
SO DO WE ANTICIPATE THAT THE TOWN IS GOING TO HAVE TO DO SOMETHING AHEAD OF TIME BEFORE IT'S PLOTTED? I DON'T KNOW THE ANSWER TO THAT QUESTION.
I DON'T KNOW IF TIFFANY DOES OR NOT.
IS IT IN THE UTILITY AND DRAINAGE EASEMENT? I THINK THAT'S WHERE THE.. THE APPLICANT SAID THAT THE TOWN MIGHT DO SOMETHING THAT REQUIRES THE REMOVAL OF IT, BUT THEY DIDN'T HAVE ANY INTENTION OF DOING THAT.
SO WE'RE TRYING TO FIGURE OUT IF WE NEED TO APPROVE A REMOVAL NOW IN CASE THE TOWN DOES SOMETHING IN THE FUTURE WHEN WE COULD PROBABLY JUST REMOVE IT IF WE NEEDED TO ONCE IT'S PLATTED. IS IT DOES HE KNOW IS IT IN A UTILITY EASEMENT OR DRAINAGE EASEMENT? IS THAT IS IT FOR MAINTENANCE IN THE FUTURE? SO A LARGE PERCENTAGE OF THE CANOPY? LET ME SEE IF I CAN POINT TO IT HERE.
THIS IS THE 17 FOOT PUD EASEMENT THE TOWN WILL OWN.
THAT'S CARRYING THE DRAINAGE THROUGH THERE.
CORRECT. SO, IN THE FUTURE, IN THE EVENT IF THE TOWN NEEDS TO COME THROUGH AND, DO ANY, GRADING OR ANYTHING IN THAT EASEMENT, THEY HAVE THE RIGHT TO DO SO.
AND IT'S JUST ADVISED THAT WE REMOVE THE TREE.
AND WE'D BE CLEANING OR TAKING CARE OF THAT TREE, AND IT COULD HOLD DRAINAGE IN THERE.
THAT WOULD PROBABLY KILL THE TREE ANYWAY.
SO THAT MAY BE WHY ENGINEERING WAS LOOKING AT IT FOR THAT REASON FOR REMOVAL.
ANYONE ELSE? QUESTIONS FOR THE APPLICANT OR STAFF? I DIDN'T HAVE ANY QUESTIONS, BUT I WANTED TO THANK YOU FOR THE EFFORT YOU PUT IN BECAUSE THERE ARE SOME MARKET CHANGES AND I THINK THERE IMPROVEMENTS.
I ESPECIALLY LIKED SLIDE 11, YOUR ENTRY SIGN.
IT'S BEAUTIFUL AND IT'S SO MUCH MORE, LIKE YOU SAID, KEEPING WITH THE NATURE OF THAT AREA.
THANK YOU. I'D KIND OF LIKE TO ECHO THOSE COMMENTS AS WELL.
I THINK, I LIKE THE CHANGES THAT WERE MADE.
YOU KNOW, IN PARTICULAR, YOU KNOW, THE MONUMENT SIGN.
YOU KNOW, I THINK THAT'S WORKING NOW WITH THE NATURAL TOPOGRAPHY OF THAT, THAT NICE HILL.
SO I THINK THAT'S A GREAT TRADE OFF.
I THINK THAT'S THE WAY THE SYSTEM OUGHT TO WORK.
AND AGAIN, YOU KNOW, IT WOULD'VE BEEN NICE TO SAY THAT TREE 1300.
BUT I UNDERSTAND WITH THE STREAM JUST TO THE WEST OF THAT THAT THAT WOULD ENCROACH THAT.
SO IT'S YOU HAVE TO PICK, YOU KNOW, THE TREE OR THE STREAM.
AND AGAIN THAT'S AGAIN STICKING WITH THAT NATURAL TOPOGRAPHY IN THAT AREA.
SO I THINK IT'S A PRETTY GOOD COMPROMISE ON ALL THESE THINGS.
THANK YOU BRIAN. ANYONE ELSE? ALL RIGHT. THE TIME IS 9:03, AND I AM OPENING THE PUBLIC HEARING FOR ITEM N TWO AND N THREE.
THERESA, DO WE HAVE ANY GREEN COMMENT CARDS? WE DO NOT. IS THERE ANYONE IN THE AUDIENCE THAT WISHES TO SPEAK DURING THE PUBLIC HEARING? PLEASE STAND UP OR RAISE YOUR HAND.
SEEING AND HEARING NONE, THE TIME IS 9:04 AND THE PUBLIC HEARING IS CLOSED.
COUNCIL FOR DISCUSSION ON THOSE TWO ITEMS. AND AS A, JUST TO REMIND YOU, WE'RE GOING TO NEED TO ENTERTAIN SEPARATE MOTIONS FOR EACH OF THOSE.
ARE WE CLEAR ON WHICH TREES OR DO YOU WANT TO TALK ABOUT THAT? I THINK THE WORD THAT OR I THINK THAT THE RATIONALE FOR EACH TREE, AS MUCH AS I'D LIKE TO TRY TO SAVE 1300 AND 632.
THERE'S A RATIONALE FOR EACH ONE, AND IT SOUNDS LIKE THE APPLICANT WILL TRY TO SAVE THEM BY BORING.
IF YOU CAN'T MOVE THE ROAD, THEN I THINK THAT THAT'S PROBABLY THE RIGHT DECISION.
SO I THINK I'M, I'M WE I THINK WE COVERED THAT.
THE ONLY OTHER THING I WAS GOING TO MENTION IS, AND YES, GREAT JOB ON ALL THE CHANGES.
I THINK YOU DEFINITELY CAPTURED OUR INTENT.
I PREFER THE STAFF LANGUAGE ON THE RETAINING WALL TO THE LANGUAGE PROPOSED BY THE APPLICANT.
[01:35:08]
WE SEE THAT SLIDE AGAIN WITH THE TWO? YEAH. PROPOSED WORDINGS.SEEMS LIKE THERE'S SOME ADVANTAGE TO DOING THE EIGHT FOOT WALL.
DEPENDING UPON THE CIRCUMSTANCES.
SO THE THE IDEA BEING THAT IF YOU, YOU'RE DOING A FOUR FOOT WALL TERRORIST.
IF IT GOES ABOVE EIGHT FEET, THEN WE NEED TO HAVE ANOTHER CONVERSATION.
BUT STAFF UP TO THAT POINT HAS DISCRETION.
I THINK THE APPLICANT SAID THAT HE'S CONCERNED THAT A FOUR FOOT WALL MIGHT BECOME A TWO FOOT WALL.
LEXIN, I DON'T I MEAN, IS THAT SOMETHING THAT THE APPLICANT NEEDS TO WORRY ABOUT WITH THIS LANGUAGE? NO, I DON'T THINK THAT WAS THE INTENT.
THEY THOUGHT IT WOULD BE, THE BEST BENEFIT TO THEM.
ALSO, JUST IN THE REDUCED COST OF NOT HAVING TO ENGINEER A WALL AND THAT SORT OF THING.
SO, NO, I MEAN, WE COULD CLARIFY IT TO SAY THAT.
I DON'T KNOW. I CAN TRY TO CLARIFY SOMETHING IN THERE.
SO IF Y'ALL WANT ME TO TWEAK THAT A LITTLE BIT BEFORE WE FINALIZE IT, TO MAKE IT CLEAR THAT WE'RE NOT SAYING EVERY SINGLE RETAINING WALL MUST BE TERRACED, IT WAS MORE OF JUST A GENERAL STATEMENT. YEAH, I THINK IT WAS OPEN ENDED ENOUGH TO GIVE STAFFS THE DISCRETION.
I ASSUME THAT STAFF WILL USE THAT DISCRETION TO MAKE IT AS EASY AS POSSIBLE FOR THE APPLICANT AND NOT THE OTHER WAY AROUND, AND IT WOULD BE STAFF GRANTING THE EXCEPTION IN EITHER CASE, RIGHT? NO, IT WOULD NOT. NO.
THAT WOULD ACTUALLY HAVE TO GO TO P&Z AND COUNCIL.
IT WOULD BE WITH THE SUBDIVISION SITE PLAN.
OKAY. SO STAFF DOESN'T GRANT EXCEPTIONS ABOVE EIGHT FEET, ONLY ABOVE EIGHT FEET.
AND I'M NOT QUITE SURE THAT THAT THAT WASN'T WHAT P&Z SUGGESTED.
AND I THINK WE KIND OF WANT TO LIMIT WE WANT TO SET A CAP SOMEWHERE ON THESE RETAINING WALLS.
SO IF WE MOVE TO APPROVE AS PRESENTED, IT WILL GO THAT ROUTE AND NOT JUST GO TO STAFF.
I'LL ENTERTAIN A MOTION FOR ITEM N TWO.
MOVE TO APPROVE ITEM N TWO AS PRESENTED.
SECOND. ANY DELIBERATION ON THAT MOTION.
THERESA, WE HAVE A MOTION AND A SECOND.
MOVE TO APPROVE ITEMS N THREE AS PRESENTED.
SECOND. ANY DELIBERATION ON THAT MOTION.
THERESA WE HAVE A MOTION AND A SECOND.
COUNCIL, DO WE HAVE ANYTHING ELSE? THE TIME IS NOW.
9:08 AND WE ARE ADJOURNED.
