AND, SO RIGHT NOW, JUST TO GIVE YOU A LITTLE OVERVIEW, TOTAL, CREDIT CARD FEE COST RECOVERY IS AT 50%. SO THAT TAKES THE TOTAL CREDIT CARD FEES CHARGED TO THE TOWN. AND SO WHAT THE CLIENT SATISFACTION AGREEMENT. SO THAT ONE, ONE OF THE TWO ITEMS THAT WE HAVE BEFORE YOU TONIGHT IS TO GO AHEAD AND LOWER THE, TO A DISCOUNT RATE OF 0.2% AND $0.10 PER ITEM. THERE WAS A GOOD BIT OF FEEDBACK THAT CAME FROM COUNCIL AT THAT MEETING, AND SO THE APPLICANT HAS TOOK THE APPLICATION BACK AND WORKED ON SOME REVISIONS. AND SO THEY'RE HERE TO PRESENT THOSE TONIGHT. SO AGAIN, LOOKING AT THE IMPACTS TO SLOPE THAT ARE GREATER THAN OR EQUAL TO 5% AND LESS THAN 12%, IT WENT FROM 61 ACRES TO CURRENTLY 50 ACRES AND IMPACTS THE SLOPE, THAT'S OVER 12% WENT FROM 6.64 ACRES TO THREE ACRES. PERCENT OF LOTS THAT ARE GREATER THAN AN ACRE WENT FROM 37% TO 27%. SO THE DIFFERENCE THERE IS SOME OF THAT LAND THAT WAS PREVIOUSLY WITHIN LOTS. SO YOU HAD MORE LOTS THAT WERE OVER AN ACRE, BECAUSE THERE WERE SOME OF THAT LAND THAT WAS WITHIN THE SLOPED AREA WAS BEING CONTAINED WITHIN THOSE LOTS. AND SO THEY PULLED IT OUT AND PUT IT INTO OPEN SPACE. SO THE OPEN SPACE WENT UP AND THE NUMBER OF LOTS THAT WERE OVER ONE ACRE WENT DOWN. BUT EVERYTHING'S STILL WITHIN THE REQUIREMENTS. LOCK COVERAGE MODIFICATION. ORIGINALLY, THE APPLICANT WAS ASKING FOR 35% FOR ALL LOTS. THEY'RE NOW ASKING FOR 25% FOR THE PRIMARY STRUCTURE FOR ALL LOTS AND 35% FOR THE PRIMARY, AND ACCESSORY STRUCTURES FOR LOTS THAT ARE LESS THAN AN ACRE. MODIFICATION TO SUBDIVISION SIGN STANDARDS. ORIGINALLY THEY WERE ASKING FOR THAT MODIFICATION AND THEY ARE NO LONGER REQUESTING THAT. AND I THINK THAT WAS SOMEWHAT OF A MISUNDERSTANDING OF JUST, WHAT WAS REQUIRED FOR WHAT THEY WERE PROPOSING IN RELATION TO THE SIGNAGE. BUT WE STAFF DID NOT HAVE A FINAL EXHIBIT AT THAT TIME, AND THEY STILL DON'T HAVE A FINAL EXHIBIT, BUT JUST UNDERSTANDING THE PARAMETERS, THEY FEEL LIKE THEY DO NOT NEED TO MODIFY THE SIGN STANDARDS. HEIGHT OF RETAINING WALLS. SO IN THE RECOMMENDATION THAT CAME FROM P&Z SAID RETAINING WALLS GREATER THAN OR EQUAL TO EIGHT FEET WOULD REQUIRE APPROVAL OF AN EXCEPTION. THAT LANGUAGE IS STILL INCLUDED. WE'VE ALSO ADDED SOME LANGUAGE BASED ON SOME FEEDBACK FROM A COUNCIL MEMBER, DURING THEIR KIND OF DISCUSSIONS WITH THE APPLICANT WHERE THEY TALKED ABOUT THE APPLICANT, TALKED ABOUT HOW THEIR GOAL WAS TO TERRACE RETAINING WALLS SO THAT THEY WOULD HAVE MORE SHORTER WALLS AS OPPOSED TO ONE REALLY TALL WALL. AND SO THERE WAS A REQUEST TO INCORPORATE SOME LANGUAGE TO ADDRESS THAT. SO, STAFF HAS ADDED SOME LANGUAGE. THE RETAINING WALL SHALL BE TERRACED TO REDUCE IMPACTS UNLESS PRESERVING AN ENVIRONMENTAL FEATURE. BUT WE STILL RETAINED THAT LANGUAGE ABOUT RETAINING WALLS GREATER THAN EIGHT FEET REQUIRE APPROVAL OF AN EXCEPTION, BECAUSE THAT CAME FROM THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION. I DO THINK THE APPLICANT WANTS TO TALK TO YOU ABOUT THAT. SO, YOU KNOW, CERTAINLY WE INVITED THEM TO DISCUSS THAT WITH COUNCIL AND GET YOUR FINAL THOUGHTS ON IT. SPECIMEN TREE REMOVAL. SO THERE ARE STILL THERE ARE STILL 18 TREES OF 135 TOTAL THAT BEER ARE BEING REQUESTED FOR REMOVAL. [00:55:02] AND ECC STILL RECOMMENDED APPROVAL OF 14 OF THE 18. SO THREE OF THE TREES CHANGED FROM ONE APPLICATION VERSION TO THE NEXT. SO THAT'S WHY THEY HAD TO GO BACK TO ECC IN FEBRUARY, BECAUSE THERE WERE THREE NEW TREES THAT WERE BEING IMPACTED BASED ON THEIR REDESIGN, BUT THREE TREES WERE NOW BEING SAVED. SO THE TOTALS DIDN'T CHANGE. BUT THAT WAS THE REASON FOR THEM GOING BACK TO ECC. SO HERE'S THE TOPOGRAPHIC SLOPE MAP JUST TO SHOW YOU WHAT WOULD BE IMPACTED. IT'S KIND OF HARD TO IT'S A LITTLE HARD TO SEE. BUT THESE ORANGE AREAS, THESE ARE ACTUALLY HATCHED. SO THESE ARE THE 5 TO 12% IMPACTS. THE AND THEN THE THE LIGHTER KIND OF YELLOWY ORANGE IS NOT IMPACTED IN 5 TO 12. AND THEN WITHIN RED YOU CAN SEE THE LIGHTER RED COLOR OR SLOPES GREATER THAN 12% THAT ARE BEING PROTECTED. AND THE DARK RED THAT'S ACTUALLY HATCHING. SO THAT'S THE AREAS THAT ARE GOING TO BE IMPACTED THAT ARE THOSE LARGER SLOPES THAT ARE MORE THAN 12%. SO THE THE LANGUAGE WITHIN THE ORDINANCE WOULD APPROVE BASICALLY THE IMPACT OF SLOPES THAT REQUIRED PER THE DESIGN OF THIS SUBDIVISION. ANOTHER MODIFICATION THAT THE APPLICANT MADE WAS TO THE 200 FOOT SCENIC CORRIDOR SETBACK. SO WITHIN THE STANDARDS OF THE NEW VERSION OF THE CROSS TIMBERS AREA PLAN, IT REQUIRES THAT 200 FOOT SETBACK ALONG SCENIC. AND THE APPLICANT HAD SOME CONCERNS ABOUT JUST THEIR ENTRANCE AND WHERE THEY NEEDED TO LOCATE IT AND TRYING TO PRESERVE SOME OF THAT TOPOGRAPHY. AND SO BECAUSE OF THAT, THEY WERE ENCROACHING SOMEWHAT INTO THAT 200 FOOT SETBACK. THIS WAS THEIR ORIGINAL REQUEST, AND THEY HAVE REDUCED THE AMOUNT OF IMPACT. AND YOU CAN SEE IN THE CURRENT REVISED VERSION, SO WHERE IT'S ONLY THERE RIGHT AT THE ENTRANCE AND THEY'VE PULLED THIS PIECE THAT WAS FURTHER SOUTH, OUT OF THAT IMPACT AREA. THIS IS JUST TO DISCUSS THE DIMENSIONAL REGULATIONS, WHAT'S CURRENT AND WHAT'S PROPOSED. SO WITH A TYPICAL AGRICULTURAL ZONING, IT'S NOT PART OF A CONSERVATION DEVELOPMENT. MINIMUM LOT AREA WOULD BE TWO ACRES AS PROPOSED. THE MINIMUM LOT SIZE IS THREE QUARTERS OF AN ACRE. MINIMUM LOT WIDTH AND AG WOULD BE 200FT. IT'S 150FT IN A STATE. THERE COULD STILL BE SOME SLOPES THAT COULD STILL OCCUR ON THE LOT THAT MAINTAIN THE SLOPE. BUT FOR NOW, WE'RE PRESUMING THAT, YOU KNOW, IT'S ON THE LOT THAT, WE'RE LOOKING AT IT BEING GONE. SO RIGHT NOW WE'RE LOOKING AT, THE AREAS IN PURPLE, THOSE ARE SHOWING THE IMPACTS. AND YOU CAN REALLY START TO SEE WITHIN THE RED BOXES WHERE A LOT OF THOSE ADJUSTMENTS MADE. SO UP ON THE TOP SIDE, THE FIRST BOX, REALLY LOOKING AT THE RECONFIGURATION OF WHAT WAS LOT 13 AND TAKING THAT OUT AND RECONFIGURING THAT. SO WE PUSHED A LOT OF THAT, 12% OR GREATER SLOPE INTO THE OPEN SPACE, THE SAME ONE DOWN TO THE LEFT. THAT WAS THE LOT SEVEN, WHICH ACTUALLY ALLOWED US TO SAVE ONE OF THE SPECIMEN TREES THERE, AS WELL AS REMOVE A SIGNIFICANT PORTION OF STEEP SLOPES THAT HAPPENED, ON THAT LOT, LOT SIX DOWN IN THE BOTTOM RIGHT. THAT'S WHERE LOT SIX WAS, HAD A PRETTY SIGNIFICANT IMPACT THERE. SO THAT'S PART OF THE RECONFIGURATION OF THE CUL DE SAC THAT COMES DOWN TO THE SOUTH THAT WE HAVE NOW PUT THAT, IN OPEN SPACE AS WELL. AND THEN AGAIN, DOWN AT THE FAR SOUTH, LOT ONE, THERE IS A CONSIDERATION ABOUT WHAT WAS THE BACK OF THAT HOUSE GOING TO LOOK LIKE AND HAVE A RETAINING WALL WITH, AN OPTIONAL FENCE THERE THAT MAY NOT HAVE LOOKED AS SIGHTLY THERE. SO WE'VE AND RECONFIGURED THOSE SO THAT THE FRONT OF THE HOUSES ARE FACING 1171 AND EVEN THE SIDE OF THAT'S REALLY, BLOCKED MOSTLY BY A LOT OF NATIVE VEGETATION THERE.
