[01:30:01] HOWEVER, THEY CAN PHASE IN A PLANNED INCREASE OF A PERIOD NOT TO EXCEED EXCEED TEN-YEARS. AND ALSO THE APPROVAL OF AN IMPACT FEE NEEDS TO BE TWO THIRDS OF THE GOVERNING BODY TO APPROVE THAT. SO THAT'S THE IMPACT FEE BASICS REFRESHER AGAIN. I'M GOING TO GO INTO THE COMPONENTS OF THE IMPACT FEE STUDY AND THE CALCULATIONS THAT WERE COMPLETED. FIRST, A REVIEW OF THE LAND USE ASSUMPTIONS, AND THEN I'LL TALK ABOUT THE, THE SERVICE UNITS THAT WERE USED IN THE CALCULATION AND THE CAPITAL IMPROVEMENT PLANS. AND JUST A QUICK SUMMARY OF THE GROWTH THAT WE DISCUSSED IN DECEMBER. THE EXISTING POPULATION WE SHOWED AT JUST OVER 81,000 PERSONS, AND WITH THE EMPLOYMENT AT JUST OVER 21,000,000FT² OF EMPLOYMENT USE AND THE TEN-YEAR PROJECTION, WE'RE PROJECTING JUST OVER 93,600 PERSONS AND JUST OVER JUST UNDER 26,000,000FT² OF EMPLOYMENT USE. AND AT BUILD OUT, JUST OVER 117,000 PERSONS AND JUST UNDER 28,000,000FT² OF EMPLOYMENT USE. AND THOSE PROJECTIONS ARE ADJUSTED ACCORDINGLY FOR THE WATER AND WASTEWATER SERVICE AREAS. EACH OF THOSE UNITS THAT EXPLAINS THE GROWTH IN TERMS OF HOW MANY HOUSEHOLDS, HOW MANY PEOPLE ARE COMING IN FOR THE ROAD IMPACT FEE PURPOSES. WE NEED TO CONVERT THAT GROWTH INTO SERVICE UNITS. THAT'S A REQUIREMENT OF CHAPTER 395. SO THERE'S TWO SEPARATE SERVICE UNITS FOR ROADWAY IMPACT FEES, AND THEN WATER AND WASTEWATER IMPACT FEES USE THE SAME SERVICE UNIT. ROADWAY IMPACT FEES USES A VEHICLE MILE AND WATER WASTEWATER IMPACT FEES USE A STANDARD WATER METER TO SERVE A SINGLE-FAMILY HOME. JUST A COUPLE SLIDES TO TRY AND BREAK DOWN HOW THOSE ARE CALCULATED. I HAVE TWO DIFFERENT EXAMPLES OF HOW THE VEHICLE MILE SERVICE UNIT CALCULATION IS DONE FOR ROADWAY, AND AS YOU TAKE THAT ONE HOME AND WE USE ITE, THE INSTITUTE OF TRANSPORTATION ENGINEERS TRIP GENERATION MANUAL HAS PUBLISHED RATES BASED ON STUDIES OF HOW MANY TRIPS PER DEVELOPMENT UNIT ARE EXPECTED TO OCCUR IN THE PM PEAK HOUR. SO FOR A SINGLE-FAMILY HOME, THAT'S 0.93 VEHICLES DURING THE PM PEAK. AND WE ALSO LOOK AT HOW FAR THOSE TRIPS ARE MADE TO MAKE SURE WE ARE ADJUSTING BASED ON THE DISTANCE. AND FOR WE USE THE NATIONAL HOUSEHOLD SURVEY FOR THAT DATA. AND SO WE MULTIPLY 0.93 BY 4.9 MILES FOR THE TRIP. AND THAT YIELDS A RESULT OF 4.55 MILES PER SINGLE-FAMILY HOME. SO THAT'S OUR SERVICE UNIT MEASUREMENT FOR A SINGLE-FAMILY HOME. FOR THE FOR A COMMERCIAL EXAMPLE I'M SHOWING A RETAIL USE, A SHOPPING CENTER AGAIN, THE TRIP RATE FROM ITE. AND THERE'S ALSO A REDUCTION FOR PASS-BY TRIPS, THAT IS FOR TRIPS THAT ARE NOT NEW TO THAT DEVELOPMENT, BUT THEY STOP BY ON, ON PREEXISTING ROUTE. SO IF YOU'RE ALREADY GOING FROM YOUR HOME TO A WORKPLACE OR SCHOOL, AND THAT NEW DEVELOPMENT POPS UP ON YOUR ROUTE, THAT THAT CAPTURES THOSE, THOSE TRIPS, SO THEY'RE NOT TECHNICALLY NEW. SO THAT'S A REDUCTION. AND THE CALCULATION FOR THAT INCORPORATING THE TRIP LENGTH, COMES OUT TO EIGHT VEHICLE MILES PER 1000FT². SO YOU CAN SEE HOW A LARGE RETAIL DEVELOPMENT WOULD GENERATE QUITE A FEW MORE VEHICLE MILES THAN A SINGLE-FAMILY HOME THAT'S A LITTLE LESS COMPLICATED. ON THE WATER AND WASTEWATER SIDE. ESSENTIALLY, LARGER BUILDINGS HAVE LARGER WATER METERS AND HAVE MORE FLOW, SO WE CHARGE THE IMPACT FEES BASED ON THE SIZE OF THE WATER METER. THIS JUST SHOWS AN EXAMPLE OF A 5/8 BY THREE QUARTER INCH METER AND A TWO INCH METER, WHICH WOULD BE TYPICAL OF A LARGER RETAIL DEVELOPMENT. AND THAT'S ESSENTIALLY THE FEES ARE SCALED UP BASED ON THEIR PROPORTION TO A SINGLE-FAMILY HOME. WATER USAGE. SO IN THIS CASE, A TWO INCH METER, WE'RE JUST SHOWING USES ROUGHLY 16 TIMES MORE WATER THAN A SINGLE-FAMILY HOME WATER METER WOULD. MOVING ON TO THE CAPITAL IMPROVEMENT PLANS FOR THE IMPACT FEE, CIP, AGAIN, WE HAVE TO LOOK AT THE NEED OF THE INFRASTRUCTURE REQUIRED TO SERVE GROWTH IN THE TEN-YEAR PLANNING WINDOW BASED ON CHAPTER 395. AND WE ALSO ARE ABLE TO INCLUDE PREVIOUSLY COMPLETED PROJECTS THAT STILL HAVE EXCESS CAPACITY TO SERVE ADDITIONAL NEW GROWTH. MOVING ON TO THE CALCULATION, THIS IS THE SAME IMPACT FEE CIP MAP FOR ROADWAY IMPACT FEES PRESENTED IN DECEMBER AND AVAILABLE IN THE DRAFT REPORT THAT WAS PUBLISHED. THIS CIP FOLLOWS YOUR ADOPTED THOROUGHFARE PLAN. THAT IS ONE OF THE ALSO ONE OF THE REQUIREMENTS OF CHAPTER 395 IS THAT THE IMPACT FEE CIP NEEDS TO BE BASED ON AN ADOPTED MASTER PLAN. AND THAT'S WHAT IS SHOWN HERE. HERE'S WHERE ALL THE PRIMARY VARIABLES COME INTO THE CALCULATION OF THE MAXIMUM FEE [01:35:10] FOR THE ROADWAY IMPACT FEES. AND SO FOR SERVICE AREA A THAT'S $682 PER VEHICLE MILE, A SLIGHT INCREASE FROM WHAT WAS BEING COLLECTED PRIOR. AND SERVICE AREA B, THAT'S $2,697 PER VEHICLE MILE. AND THEN SERVICE AREA C IS THE MOST SIGNIFICANT INCREASE AT $8,552 PER VEHICLE MILE. AND YOU CAN SEE THAT THAT INCREASE OR THAT PERCENTAGE THAT'S CURRENTLY BEING COLLECTED IN THE RIGHT HAND COLUMN ON THIS TABLE. SO IF YOU REMEMBER WE HAVE POTABLE WATER, BUT ALSO A REUSE SYSTEM AS WELL. SO THESE ARE JUST THE PROJECTS FOR POTABLE. THERE'S JUST ONE SINGLE SERVICE AREA FOR WATER FOR THE ENTIRE TOWN. AND THEN WE HAVE TWO SEPARATE REUSE SYSTEMS. SO HERE'S THE DENTON CREEK REUSE SYSTEM HERE. AND THEN WE ALSO HAVE THE ON THE EAST SIDE, THE LAKE SIDE REUSE SYSTEM AS WELL. ALL OF THESE ARE INCLUDED IN THE MASTER PLAN. SO FOR THE WATER IT'S BREAKING DOWN A LITTLE SIMPLER THAN THE ROADWAY, WHERE IT'S JUST A SINGLE SERVICE AREA. AND SO WE'RE WE HAVE A TOTAL CIP COST FOR THESE PROJECTS IN THE TEN-YEAR WINDOW OF ALMOST $267 MILLION. WHAT WE'RE ABLE TO RECOVER IN THAT TEN-YEAR PERIOD IS JUST SOUTH OF $94 MILLION, WITH APPROXIMATELY 07,530 SERVICE UNITS OF GROWTH IN THAT TEN-YEAR PERIOD. SO HOW DOES THAT MATH PLAY OUT? SO FOR 2025, WE'RE LOOKING AT $12,446. IN 2020, THE CALCULATED MAXIMUM WAS $4,676. THE CURRENT ADOPTED FEES ARE NOT AT FULL 100%, THEY'RE AT 80%. SO WE'RE AT $3,741 CURRENTLY FOR BOTH RESIDENTIAL AND NONRESIDENTIAL. THEY ARE THE SAME. AND THIS IS JUST FOR A SINGLE SERVICE UNIT. SO THIS IS SINGLE-FAMILY HOME EQUIVALENT. AND THEN FOR MOVING ON TO THE WASTEWATER SIDE. SO WE'VE GOT THE E SYSTEM WHICH CONSISTS OF TWO DIFFERENT SERVICE AREAS LONG PRAIRIE AND LAKESIDE AND THE WEST WASTEWATER SYSTEM. IF YOU REMEMBER FROM THE MASTER PLAN, WE'VE COMBINED THE DENTON CREEK AND THE KYLE, WHICH WHAT WAS IT? SO IT'S ALL IN ONE. WE CREATED A MODEL FOR THE FIRST TIME FOR THIS AREA HERE. AND THOSE ARE THE ASSOCIATED PROJECTS FOR THAT AREA. SO THE MATH BREAKS DOWN WHERE WE HAVE A TOTAL CIP OF JUST OVER 31 MILLION FOR LONG PRAIRIE ABLE TO RECOVER 11 MILLION OF THAT IN THE TEN-YEAR PERIOD WITH 1,250 SERVICE UNITS AND THE TEN-YEAR GROWTH LAKESIDE JUST NORTH OF $15 MILLION, WITH $2.8 MILLION ON THE RECOVERABLE COST A LITTLE BIT MORE SERVICE UNITS IN THAT AREA. AND THEN DENTON CREEK BEING THE LARGER OF THE THREE, WHERE WE HAVE JUST SOUTH OF $47 MILLION AND ABOUT $20,500,000 RECOVERABLE WITH THE MOST AMOUNT OF SERVICE UNITS IN THAT AREA, CLOSE TO 5,400 WITH A TOTAL SERVICE UNIT GROWTH OF ALMOST [01:40:09] 09,000 RECOVERABLE OF A LITTLE BIT OVER $34 MILLION. AND THAT'S JUST A FRACTION OF THE TOTAL OF THE $93 MILLION JUST IN THE TEN-YEAR PERIOD. SO BREAKING DOWN TO A FEE. WE'LL COMPARE LONG PRAIRIE HERE FIRST. SO $5,621 IS OUR 2025 MAXIMUM. AND THEN WE HAVE OUR CROSS TIMBERS IN CENTRAL FLOWER MOUND, WHERE THERE IS NO PUBLIC SEWER SERVICE AND IS A SEPTIC SYSTEM. SO HOW DOES THAT BREAK DOWN FOR A SINGLE-FAMILY HOME IN FLOWER MOUND? I'M JUST CURIOUS A LOT OF THEM ARE PRETTY BUILT OUT. SOME OF THEM JUST CHOOSE NOT TO USE THAT AS A FUNDING TOOL FOR, FOR THE ROADWAY PURPOSES. AND IF I COULD JUST AS AN EXAMPLE, MY LAST TWO STOPS DID NOT HAVE IMPACT FEES, BOTH ABILENE AND IRVING. THAT'S SOMETHING THAT WE TALKED ABOUT, SOMETHING WE WISH WE HAD. SO SOME MUNICIPALITIES JUST DON'T HAVE THEM, MAYBE BECAUSE THEY'RE BUILT OUT IN SOME OTHER FACTORS. SO REVIEW OF GENERAL PHILOSOPHIES. IF A MUNICIPALITY DOES NOT INCUR OR PASS ALONG IMPACT FEES, DOES THAT MEAN THAT THE MONEY COMES FROM THE RESIDENTS, THE EXISTING RESIDENTS? BECAUSE THEY'RE OBLIGATED TO PAY FOR THESE THINGS. I MEAN, AS A MUNICIPALITY, WE'RE OBLIGATED TO PAY FOR CERTAIN TYPES OF THINGS LIKE SERVICES. [01:45:01] SO IF WE DON'T ENACT IMPACT FEES, THEN IT MEANS THE RESIDENTS ARE SUBSIDIZING THE NEW DEVELOPMENT. THEY'RE GOING TO ABSORB IT YEAH. RIGHT. I JUST WANTED TO MAKE SURE WE'RE ALL AWARE OF THAT. AND I'M GONNA YOU AGREE WITH WHAT I'M ABOUT TO SAY. SO THE MAXIMUM ACCESSIBLE, ACCESSIBLE IMPACT FEE, WHICH IN THIS CASE SERVICE SERVICE AREA C WOULD BE $38,000 FOR ROADS BECAUSE THEY DON'T HAVE ANY ROADS AND THEY NEED TO BE BUILT. THAT'S THE TRUE COST OF ONE OF THOSE UNITS TO BRING ROADWAY TO THAT, SO THAT THEY HAVE ALL THE ROADS THEY NEED TO DRIVE AROUND. THAT'S WHAT IT COSTS TO BRING THE ROADS. IF YOU LOOK AT EVERY UNIT IN THAT SERVICE AREA. IS THAT RIGHT? YES THAT'S CORRECT. OKAY. SO IF WE ADOPT LESS THAN 100% OF THE MAX FEE, THE TAXPAYERS ARE PAYING FOR IT IN THE INSTEAD OF THE DEVELOPERS, IS THAT CORRECT? YEAH. THAT'S CORRECT. SO IT'S A SUBSIDY TO THE DEVELOPERS. THAT'S A CHOICE. YES. NO. AND WE DON'T WANT TO PUT THAT ON THE IT WAS ONE OF THE FIRST BIG THINGS I HAD TO DO ON COUNCIL. AND CAN I INTERRUPT REAL QUICK? WE HAD THAT DISCUSSION AFTER 2020. RIGHT? SO WE MUST HAVE TAKEN THE 2020 IMPACT FEES AND THEN INCREASED THEM. IS THAT THE DECISION THAT WE WERE MAKING? I WAS THERE. YES. AND THEN WE HAD A DISCUSSION TO GO FROM 80% TO 100% IS WHAT I RECALL. WELL WE DIDN'T GO TO 100%. WE WENT TO 80%. BUT THE PROBLEM WAS THESE SAY THAT WE'RE 80%. CORRECT? WELL THAT WAS 2020. ACTUAL. BUT WE ARE HIGHER THAN THAT BECAUSE WE HAD THAT DISCUSSION IN 2021 OR 2022 TO INCREASE TO 100%. I SURE REMEMBER. I VOTED IN EARLY 2021 BECAUSE I GOT ON COUNCIL IN 2020 NOVEMBER. SO IT WAS ONE OF THE FIRST BIG THINGS I HAD TO DO. AND I'M PRETTY SURE WE WERE REMOTE BECAUSE I HAVE THIS VISION OF DOING IT FROM HOME. BUT ANYWAY. I WAS THERE TOO. OKAY. SO THE OTHER THING I WANTED TO SAY IS THAT I THINK ONE OF THE REASONS WE DIDN'T LAND ON THE 100% IS BECAUSE THE PRIOR FEES WERE DEEPLY, DEEPLY, DEEPLY DISCOUNTED. AND I REMEMBER AT LEAST ONE PERSON ON COUNCIL. SORRY. BECAUSE I'M. I WISH YOU WERE ALL OVER HERE. ONE PERSON WAS DEAD SET AGAINST INCREASING THEM BECAUSE THEY SAID, OH, NO ONE WILL EVER COME HERE. SO IF WE WANT TO KEEP TRACK OF INFLATION, IF WE WANT TO GO FROM $3,294 TO $8,552. JUST TO KEEP TRACK WITH INFLATION. THEY'RE BASICALLY PUTTING ROADBLOCKS IN THE WAY OF US DOING THAT. YET THE SAME LEGISLATURE IS ALSO TRYING TO SQUEEZE US ON PROPERTY TAX, SAYING YOU HAVE TO CUT PROPERTY TAX, PROMISING PROPERTY TAX CUTS. BUT ANYTHING LESS THAN 100% MEANS OUR RESIDENTS ARE PAYING FOR IT, SUBSIDIZING THE DEVELOPER'S PROFITS THROUGH THEIR PROPERTY TAX. BUT THEN THEY TO THE RIGHT HAND IN THE LEGISLATURE IS MY THOUGHT, BECAUSE THEY CAN'T. THEY'RE ASKING US TO DO BOTH THINGS. AND YOU'RE RIGHT, THEY DO NOT RECONCILE. AND ALSO IF WE IF WE HAVE TO HAVE A VATRE TO RAISE THE TAX RATE TO COVER THINGS LIKE THIS, PEOPLE WILL SAY NO. SO THEN I DON'T REALLY KNOW WHAT HAPPENS TO US, HOW WE'RE OBLIGATED TO PROVIDE THESE SERVICES, BUT WE CAN'T PAY FOR THEM. SO WE ARE IN A BIND ON THAT. SO YOU HAD MENTIONED A THREE-YEAR ROADMAP? BECAUSE THE LEGISLATURE MIGHT SAY LOWERING IMPACT FEES LOWERS THE COST OF HOUSING. HOUSING IS TOO EXPENSIVE BECAUSE MUNICIPALITIES ARE GOUGING ALL THESE DEVELOPERS ON IMPACT FEES. AND I ASSURE YOU, HOUSING COSTS WHATEVER THE MARKET WILL BEAR. THAT'S WHAT THE PRICE OF HOUSING IS. IF WE LOWER IMPACT FEES, IT DOESN'T LOWER THE PRICE OF HOUSING. THE MARKET SETS THE PRICE. WE'RE SUBSIDIZING THE PROFIT OF THE DEVELOPER. THAT'S WHAT IT DOES. AND THERE'S A CASE TO BE MADE FOR THAT, BUT NOT IN FLOWER MOUND WHERE THEY'RE BEATING OUR DOOR DOWN TO BUILD HOUSES AND DEVELOP. SO IT SHOULD BE 100%. IT SHOULD BE 100% RIGHT NOW, AS SOON AS WE CAN GET IT. AT WHAT POINT DOES THE IMPACT FEE GET CHARGED? AT WHAT POINT IN THE DEVELOPMENT PROCESS? SO ONCE YOU.
