WHEN MY FAMILY FIRST BOUGHT OUR HOME IN EARLY 2019, THE LOT ACROSS THE STREET FROM LAKE FLOWER DRIVE WAS NOTHING MORE THAN A FIELD WITH GRAZING COWS IN IT.
BUT IN THE LAST FEW YEARS, CONSTRUCTION BEGAN ON A NEW STRIP MALL, AND SINCE THEN, THEY'VE ADDED A DENTAL OFFICE, A DOUGHNUT SHOP, A SPA, PIZZA PLACE, AND NOW A NEW MONTESSORI SCHOOL.
THE LOT ADJACENT TO THAT ONE HAS CONSTRUCTION ONGOING.
WHILE DEVELOPMENT BRINGS PROGRESS AND A HIGHER TAX BASE TO MAINTAIN OUR OUTSTANDING CITY SERVICES, IT'S ALSO BROUGHT UNINTENDED CONSEQUENCES THAT ARE PUTTING OUR SAFETY AT RISK EVERY SINGLE DAY.
ON MY COMMUTE HOME FROM WORK, TURNING LEFT ONTO MY STREET HAS BECOME A NIGHTMARE.
THE NEW BUILDINGS IN THE LOT EAST OF LAKE FLOWER DRIVE, AND THE SOUTHBOUND LEFT TURN LANE THAT'S CREATED TO ACCESS THOSE BUILDINGS HAVE CREATED A BLIND SPOT IN BOTH DIRECTIONS.
WHEN TWO CARS SIT IN THEIR RESPECTIVE LEFT TURN LANES FACING EACH OTHER, NEITHER CAN SEE THE ONCOMING TRAFFIC; I CAN'T SEE THE SOUTHBOUND TRAFFIC AND THEY CAN'T SEE THE NORTHBOUND TRAFFIC.
IT'S LIKE PLAYING RUSSIAN ROULETTE WITH THE RUSH HOUR TRAFFIC.
IN JUST THE LAST FEW MONTHS, THIS HAS LED TO NEAR MISSES, HONKING HORNS, AND ESCALATING TENSIONS.
I'VE PERSONALLY BEEN CUSSED OUT, YELLED AT, AND FLIPPED OFF, SIMPLY FOR SITTING IN MY LANE OF TRAFFIC WITH MY TURN SIGNAL ON BECAUSE THE OTHER DRIVER CAN'T SEE AROUND MY CAR.
AND WHEN THE TRAFFIC IS BACKED UP AND THE TEMPERS ARE ALREADY HIGH, THESE SITUATIONS CAN TURN DANGEROUS FAST.
WE'RE NOT TALKING ABOUT MINOR INCONVENIENCES, WE'RE TALKING ABOUT POTENTIAL ACCIDENTS THAT COULD INJURE PEOPLE, ESPECIALLY CHILDREN WHO ATTEND THAT NEW MONTESSORI SCHOOL, WHOSE PARENTS HAVE NO WAY TO TURN LEFT SAFELY.
BUT THIS IS ONLY GOING TO GET WORSE, WITH EVEN MORE BUILDINGS UNDER CONSTRUCTION AND A NEW NEIGHBORHOOD BEING DEVELOPED NEAR SHADOW RIDGE MIDDLE SCHOOL, TRAFFIC VOLUME IS ONLY GOING TO INCREASE.
WHAT WE HAVE NOW IS A PROBLEM.
IN A FEW YEARS, IT COULD BE A CRISIS.
WE'VE ALL SEEN HOW UNCHECKED GROWTH CAN OVERWHELM OUR ROADS.
LET'S NOT WAIT FOR A TRAGEDY TO FORCE OUR HANDS.
AND THAT'S WHY I'M HERE TODAY, URGING YOU TO HELP US GET AHEAD OF THIS.
WE NEED A TRAFFIC LIGHT INSTALLED AT THIS INTERSECTION TO RESTORE VISIBILITY, REDUCE RISK, AND ENSURE SAFE ACCESS FOR RESIDENTS IN MY NEIGHBORHOOD AND PATRONS OF THESE BUSINESSES.

BUT MORE IMPORTANTLY, TONIGHT, I AM SPEAKING AS SOMEONE DEEPLY INVESTED IN THE QUALITY OF EDUCATION ACROSS OUR NORTH TEXAS COMMUNITIES, INCLUDING THE MANY FAMILIES IN FLOWER MOUND WHO ATTEND SCHOOLS IN THE LEWISVILLE INDEPENDENT SCHOOL DISTRICT.
MANY OF YOU KNOW THAT A SIGNIFICANT PORTION OF FLOWER MOUND FALLS WITHIN LISD BOUNDARIES, CAMPUSES LIKE FLOWER MOUND HIGH SCHOOL, MARCUS HIGH SCHOOL, OLD SETTLERS ELEMENTARY, AND OTHERS SERVE OUR NEIGHBORS AND CONTRIBUTE TO THE STRONG REPUTATION THAT MAKES FLOWER MOUND SUCH A DESIRABLE PLACE TO LIVE, RAISE FAMILIES, AND INVEST IN HOMES.
OUR SCHOOLS, PARTICULARLY THOSE IN FLOWER MOUND FEEDER PATTERNS, ARE CONSISTENTLY AMONG THE HIGHEST PERFORMING IN THE REGION WITH FLOWER MOUND HIGH SCHOOL EARNING TOP NATIONAL AND STATE RANKINGS, AND OVERALL DISTRICT BENEFITING FROM THAT EXCELLENCE.
HOWEVER, I'M HERE TO RAISE AWARENESS ABOUT A PROPOSED CHANGE IN LISD THAT COULD HAVE RIPPLE EFFECTS ON OUR COMMUNITY; THE POTENTIAL RELOCATION OF THE DISCIPLINARY ALTERNATIVE EDUCATION PROGRAM CALLED DAEP, SPECIFICALLY THE ELEMENTARY DAEP FROM ITS CURRENT DEDICATED STANDALONE FACILITY AT THE STUDENT SUCCESS CENTER TO EXISTING REGULAR ELEMENTARY CAMPUSES, INCLUDING OLD SETTLERS ELEMENTARY.
THIS PROPOSAL PRESENTED IN THE LISD BOARD WORK SESSION ON DECEMBER 1, 2025, AND STILL UNDER CONSIDERATION WITH POSSIBLE IMPLEMENTATION AS EARLY AS THE 2026-2027 SCHOOL YEAR, STEMS FROM DECLINING ENROLLMENT AND SURPLUS FACILITIES.
WHILE THE DISTRICT STATES THAT RELOCATED DAEP PROGRAMS WOULD OPERATE INDEPENDENTLY WITH SEPARATE ENTRANCES AND SPACES, THE SHIFT FROM A FULLY ISOLATED PURPOSE BUILT SITE TO SHARING A CAMPUS WITH A REGULAR ELEMENTARY SCHOOL MARKS A MAJOR CHANGE.
WHY DOES THIS MATTER TO FLOWER MOUND? HERE ARE MY KEY CONCERNS: IMPACT ON SCHOOL REPUTATION AND PROPERTY VALUES.
FLOWER MOUND THRIVES BECAUSE OF ITS EXCEPTIONAL SCHOOLS.
FAMILIES MOVE HERE FOR THE HIGH RATE IN SAFETY PRESUMPTIONS AND ACADEMIC EXCELLENCE.
CO-LOCATING A DISCIPLINARY PROGRAM, EVEN WITH SEPARATIONS ON A REGULAR CAMPUS COULD ALTER THAT PERCEPTION.
COMPETITIVE STANDING IN THE EDUCATION MARKET.

IT'S A LITTLE LESS THAN 27 ACRES.
IT IS FOR MEDIUM DENSITY RESIDENTIAL.
THERE ARE 10,000 SQUARE FOOT LOTS, MINIMUM SIZE FOR THE RESIDENTIAL.
THERE'S 65 TOTAL LOTS THAT ARE BEING PROPOSED.
THIS IS THE MOST NORTHERN PORTION.
THEN AGAIN, THIS IS THAT CAMPUS COMMERCIAL PIECE THERE AT THE CORNER.
THAT'S NOT ACTUALLY BEING DEVELOPED AT THIS POINT OR THIS APPLICANT IS NOT REPRESENTING THAT PROPERTY'S DEVELOPMENT.

I FREQUENTLY HEAR FROM THE COUNCIL AND PLANNING & ZONING COMMISSION, THEY'D LIKE TO KNOW WHEN APPLICANTS WORK WITH THE TOWN TO TRY TO ADDRESS SOME OF THESE CONCERNS.
ORIGINALLY, THE APPLICANT WAS PROPOSING TO INCLUDE SIX LOTS IN THE NORTHLAKE AREA THAT WAS WITHIN THERE.
AND STAFF HAD A LOT OF CONCERNS ABOUT JUST HAVING A HANDFUL OF LOTS BEING IN A DIFFERENT JURISDICTION AND THOSE RESIDENTS HAVING TO HAVE DIFFERENT CODE ENFORCEMENT, DIFFERENT TRASH SERVICE, DIFFERENT UTILITIES, ALL THAT SORT OF THING.
WE WORKED WITH THE APPLICANT, AND THEY WERE WILLING TO RECONFIGURE THEIR SUBDIVISION LAYOUT SOMEWHAT SO THAT THEY COULD BRING THOSE LOTS OUT OF THE NORTHLAKE AREA AND REPOSITION THEM SO THEY'RE ALL LOCATED WITHIN THE FLOWER MOUND BOUNDARIES SO THAT THAT WHOLE NEIGHBORHOOD WILL BE PART OF THE SAME JURISDICTION.
SO I DID JUST WANT TO RECOGNIZE THAT EFFORT BY THE APPLICANT.
THEN HERE IS THE THIRD PIECE OF THE SUBDIVISION SITE PLAN.
THIS IS GOING MORGAN OVER TO THE SIDE TO THE CANYON FALLS AREA WHERE THE ROAD WITH DENTON CREEK WOULD BE CONSTRUCTED.
THERE ARE TWO EXCEPTIONS THAT ARE INCLUDED AS PART OF THIS REQUEST.
THE FIRST IS A SLOPE EXCEPTION.
ALL OF THE AREA IN YELLOW IS THE 5-12% SLOPE.
THE AREA THAT'S BEING REQUESTED FOR THE EXCEPTION IS 1.92 ACRES.
THERE'S A LITTLE OVER 10 ACRES OVERALL THAT IS THAT 5-12%.
HOWEVER, BECAUSE OF THE WAY THE TOWN'S ORDINANCE IS WRITTEN, YOU'RE ONLY REQUIRED TO REQUEST THE EXCEPTION IF YOU'RE GOING TO IMPACT MORE THAN FIVE FEET OUT FROM WHERE YOU STOP CONSTRUCTION.
THE ONLY PARTS THAT MEET THAT REQUIREMENT, OR THE 1.92 ACRES.

THIS IS A SLIGHT REDUCTION FROM THE NUMBER THAT WENT FORWARD TO THE PLANNING AND ZONING COMMISSION AND TALKING TO THE APPLICANT AND REVIEWING THE MAP AFTERWARDS, WE REALIZED THAT SOME OF THE AREA THAT WAS IN NORTHLAKE HAD BEEN INCLUDED WITHIN THAT AND SO THAT WAS TRIMMED DOWN A LITTLE BIT.THEN THERE IS 0.06 ACRES THAT IS GREATER THAN 12% SLOPE, SO THAT'S THIS LITTLE SQUARE RIGHT HERE.
THAT AREA DOES ALWAYS REQUIRE APPROVAL OF AN EXCEPTION BY THE COUNCIL.
I DID WANT TO MENTION THAT THERE ARE NO RETAINING WALLS THAT ARE OVER EIGHT FEET INCLUDED IN THE SUBDIVISION.
I KNOW THAT WAS A STANDARD THAT THE COUNCIL HAS SOMETIMES LOOKED AT WHEN CONSIDERING THESE TYPE OF EXCEPTIONS.
THERE'S ALSO AN EXCEPTION REQUESTED FOR IMPACTING FLOODPLAIN AREA.
THE APPLICANTS REQUESTING EXCEPTION TO ALLOW CONSTRUCTION AND CONSTRUCTION-RELATED ACTIVITY WITHIN THE FULLY DEVELOPED FLOODPLAIN.
THIS IS NOT AREA THAT IS CURRENTLY FEMA FLOODPLAIN, BUT IT'S AREA THAT BASED ON THE TOWN'S ANALYSIS WOULD BECOME FLOODPLAIN IN THE FUTURE WHEN THE AREA IS FULLY DEVELOPED.
THAT'S A STEP FURTHER THAT FLOWER MOUND DOES THAT'S NOT TRULY REQUIRED BY FEMA IN ORDER TO BE THE MOST PROTECTIVE.
THE ONLY AREA THAT'S BEING INCLUDED WITHIN THIS EXCEPTION IS THE GRADING.
IT'S NOT THAT THEY'RE GOING TO PUT FLOODPLAIN WITHIN ACTUAL RESIDENTIAL LOTS; THAT'S NOT EVEN ALLOWED BY THE TOWNS CODE.
I ALSO JUST WANTED TO CLARIFY THAT WITHIN THE TOWNS ORDINANCES, WE DO REQUIRE THAT EVEN IF SOMEONE IS GRANTED THE EXCEPTION, THEY HAVE TO DO A MODEL, FLOOD STUDY, HAVE IT REVIEWED BY STAFF, AND CONFIRM THAT EVEN WITH WHATEVER IMPACTS THERE ARE, LIKE SAID IN THIS CASE, IT'S THE GRADING, THAT THERE WILL BE NO INCREASE IN THE WATER SURFACE ELEVATIONS FOR THE FULLY DEVELOPED AREA, AND ALSO NO INCREASE IN VELOCITIES FOR ANY OFFSITE PROPERTY UNDER DIFFERENT OWNERSHIP.
SO THEY HAVE MET BOTH OF THOSE CONDITIONS WITH THIS EXCEPTION REQUEST. YES, MAYOR.
>> I'M A LITTLE CONFUSED ON THAT. SO IF THEY'RE NOT GOING TO BE DOING RESIDENTIAL IN THERE, WHAT'S THE PURPOSE OF BUILDING IN THIS FLOODPLAIN?

IN THIS AREA HERE, YOU CAN SEE SOME OF THESE LOTS BACK UP TO IT.
SO MY UNDERSTANDING IS THAT A COUPLE OF DIFFERENT REASONS THEY'RE WANTING TO DO SOME GRADING WITHIN THERE, ONE IS TO ENSURE THAT THEY DON'T HAVE REALLY TALL, RETAINING WALLS AT THE PROPERTY LINES, THEY'D RATHER GRADUALLY GRADE IT BACK THERE.
THEY COULD HAVE TRIED TO GO THE ROUTE OF JUST TOTALLY NOT TOUCHING IT AT ALL, BUT IN ORDER TO DO THAT, LIKE SAID, IT WOULD HAVE CREATED REALLY TALL, RETAINING WALLS.
I THINK EVERYBODY, BOTH THE APPLICANT, AND THE TOWN'S FLOODPLAIN MANAGER HAD CONCERNS ABOUT THAT.
JUST THE ONGOING MAINTENANCE AND STABILITY TYPE OF THING.
ALSO, MY UNDERSTANDING, AND THIS IS MY MINIMAL UNDERSTANDING, WE'LL GET THE APPLICANT UP OR POTENTIALLY TALK TO BRIAN, IF YOU'LL HAVE ADDITIONAL QUESTIONS ABOUT THIS, BUT IS THAT IN ORDER TO ENSURE THE VELOCITIES ARE NOT INCREASED, THEY ALSO NEEDED TO DO SOME GRADING SO IT WASN'T SO STEEP SO THAT IT TRAVELS OVER WATER; THE WATER TRAVELS OVER A LARGER SURFACE AREA, AND IT SLOWS IT DOWN THAT WAY.

ALSO, THE APPLICANT HAS A VESTED INTEREST TO MAKE SURE THAT IT WORKS RIGHT.
I THINK THE DRAINAGE IS GOOD, THE X LOTS WITH THE HOA, SOME OF THE SLOPE EXCEPTIONS, SOME OF THE RETAINING WALLS.
WE GOT THAT THROUGHOUT A LOT OF CANYON FALLS WITH THE RETAINING WALLS, LOT TO LOT, LOT TO X LOT, LOT TO OPEN SPACE.
THAT'S CONSISTENT WITH WHAT'S IN THERE.
WE JUST RECENTLY HAD AN ISSUE IN CANYON FALLS INVOLVING A BEAVERS DAMMING THEM UP, A RETENTION AREA.
THAT CAUSED A LOT OF REWORK, AND THAT WENT ON A LOT LONGER THAN YOU WOULD HAVE LIKED.
I THINK EVERYONE WOULD HAVE LIKED.
BUT THE END OF THE DAY, IT WAS THE HOA THAT, MADE IT RIGHT, AND THEY'RE JUST FINISHING THAT REHAB PROJECT THAT CHANNEL.

THERE IS A PRECEDENT THAT THE HOA IS GOING TO TAKE CARE OF WHAT THE HOA IS RESPONSIBLE FOR.OBVIOUSLY, WE CAN'T TALK FOR 20 YEARS ON THE ROAD.
BUT THOSE MECHANISMS, THOSE CONTRACTS ARE IN PLACE TO MAKE SURE IT IS MAINTAINED, AND WHEN THERE IS AN ISSUE TO TAKE CARE OF THAT.
I DO APPRECIATE HOW NOT JUST IN THAT ONE AREA THAT WE FOCUSED ON, BUT SOME OF THOSE OTHER AREAS TO THE EAST, HOW IT DOES EXTEND A LITTLE BIT PAST THE PROPERTY LINE OF THAT NEIGHBORHOOD TO ENSURE A MORE GRADUAL SLOPE, TO ENSURE A MORE NATURAL LOOK.
EITHER ELIMINATE RETAINING WALLS OR REDUCE THE HEIGHT OF THEM.
I THINK APPLICANTS DONE A REALLY GOOD JOB.
ONE OF THINGS THAT WE LIKE TO TALK ABOUT IS WORKING WITH THE TOPOGRAPHY.
I THINK THEY'RE WORKING WITH THE TOPOGRAPHY AS MUCH AS POSSIBLE AND STILL DEVELOPING THE LAND.
I THINK THEY HAVE HIT A SWEET SPOT ON IT.
I THINK THE SLOPE AND AND WORKING IN THAT FLOODPLAIN MAKES SENSE IN THIS CASE.
