I, I HAVE BEEN HONESTLY CALLING THE CITY COUNCIL AND THE CITY ABOUT THIS TOPIC FOR WEEKS, LEAVING MESSAGES WITH THE ENGINEERING DEPARTMENT, THE PUBLIC WORKS DEPARTMENT. NOBODY WILL CALL ME BACK OR SPEAK TO ME.

SO THAT'S ISSUE NUMBER ONE, WHICH IS NOT ON THE AGENDA.

ISSUE NUMBER TWO I AM HAVING ISSUES WITH PROVIDING THE POLICE MORE EQUIPMENT, WHICH IS AN AGENDA ITEM, BECAUSE I HAVE A LOT OF EVIDENCE THAT WE HAVE A POLICE FORCE PURPOSELY RETALIATING AGAINST CRIME VICTIMS FOR REPORTING, CHARGING DOMESTIC VIOLENCE VICTIMS. JUST TWO MORE POINTS. THEY ARE PROVABLY FILMED, AND MEDICAL EXAMINERS CONFIRMED EVIDENCE OF HEINOUS ASSAULT, WRONGFULLY CHARGING THEM THAT THEY KNOW ARE TRUTHFUL VICTIMS AS A METHOD OF SHAMING AND WITNESS INTIMIDATION WITH MAKING A FALSE REPORT THAT THEY KNOW IS TRUE, AND THEN LATER DROPPING THE CHARGES. POINT TWO THERE'S FALSIFIED CRIME STATS GIVING PEOPLE A FALSE SENSE OF SECURITY BY NOT ACCURATELY DOCUMENTING, INVESTIGATING, SUBMITTING EVIDENCE TO THE DA, OR EVEN RESPONDING TO SEVERE CRIMINAL OFFENSES, INCLUDING LIFE THREATENING ONES AND SPECIFIC COVER UP AND NON-INVESTIGATION OF POLICE MISCONDUCT.

AND THEN LASTLY, JUST WE'RE ADDING A REFERENCE TO THE APPLICATION FEE FOR THE SEWER CONNECTION EXCEPTION THAT'S ALREADY WITHIN THE LAND DEVELOPMENT REGULATIONS, BUT IT WASN'T ACTUALLY IN APPENDIX A AND THE FEE SCHEDULE.

SO WE JUST TRY TO HAVE IT SHOW UP THERE AS WELL.

SO GOING INTO A LITTLE BIT MORE DETAIL SECTION 82 242 STREET BUFFER LANDSCAPING.

SO THE RECOMMENDATION HERE IS TO INCORPORATE AN EXCEPTION THAT WOULD ALLOW FOR THE WAIVER OR MODIFICATION OF LANDSCAPE BUFFER REQUIREMENTS UNDER SPECIAL CIRCUMSTANCES, PROVIDING THAT ALL THE REQUIRED TREES ARE STILL PLANTED SOMEWHERE ON SITE.

AND SO THIS KIND OF JUST TO GENERALLY SHOW YOU THE CURRENT LANGUAGE THAT WE HAVE IN PLACE, YOU KNOW, STREET BUFFER LANDSCAPING IS REQUIRED COUNTS TOWARDS STREET YARD, LANDSCAPE, STREET YARD, LANDSCAPING ADJACENT TO STREET RIGHT OF WAY. AND SO THIS IS THE FIRST SECTION PRINCIPAL STREETS.

IT GOES ON TO SAY FOR DIFFERENT STREETS THE WIDTH OF THE LANDSCAPE BUFFER.

BUT JUST TO GIVE YOU A GENERAL IDEA OF WHAT WE'RE TALKING ABOUT HERE.

BUT SO THAT WOULD STILL BE IN PLACE AND AS WOULD THE REQUIREMENT OF E THAT THE STREET BUFFER LANDSCAPING AREAS HAVE TO COMPLY WITH SECTION 9462, CHAPTER 94 IS THE TREE ORDINANCE. AND SO THAT'S WHERE IT DEFINES THE ACTUAL NUMBER OF TREES THAT HAVE TO BE PLANTED.

TYPICALLY IT'S ONE FOR EVERY 30 LINEAR FEET OF FRONTAGE.

SO THAT WOULD STILL BE IN PLACE. IT WOULD JUST ALLOW FOR A WAIVER OR MODIFICATION BASICALLY TO WHERE THOSE TREES GET PLANTED.

AND SO HERE'S AN EXAMPLE I GAVE YOU OF A PAST PROJECT.

THERE WAS THIS LARGE DRAINAGE EASEMENT THAT WAS RIGHT UP NEXT TO THE ROAD.

AND SO THE APPLICANT HAD DIFFICULTY MEETING THAT THE TREES WOULD ALL BE PLANTED WITHIN 25FT OF THE ROADWAY BECAUSE THEY COULDN'T PLANT THEM IN THE LANDSCAPE BUFFER AND WITHOUT POTENTIALLY IMPACTING OR THEY COULDN'T, I'M SORRY, THEY COULDN'T PLANT THEM IN THE DRAINAGE EASEMENT WITHOUT POTENTIALLY IMPACTING HOW THAT DRAINAGE FUNCTIONED. AND SO IN THIS CASE, THEY DID IT BEHIND THE THE DRAINAGE EASEMENT.

THEY CREATED A LARGER SECTION THERE TO THE WEST OF THE DRIVEWAY.

AND THEN ALSO THEY DID A DEEPER SECTION ON THE EAST SIDE.

SO AGAIN, THIS IS JUST THE KIND OF THING THAT WE'RE TALKING ABOUT THAT THIS PARTICULAR CASE, IT WAS PART OF A PD. SO THEY WERE ABLE TO PROPOSE THIS THROUGH THE PD.

BUT ONE OF THE ONE OF THE FEEDBACK OPTIONS WE RECEIVED DURING THE FLOMO CONVOS WAS THAT IT WOULD BE GREAT TO PROVIDE OPPORTUNITIES TO NOT GO THROUGH KIND OF UNNECESSARY STEPS, AND SO IN THIS CASE, HOW IT STANDS NOW, BECAUSE WE DON'T HAVE IT AS AN EXCEPTION THAT CAN BE REQUESTED, SOMEONE WOULD HAVE TO REQUEST A ZONING CHANGE IN ORDER TO DO THIS.

SO THIS WOULD ALLOW THE APPLICANT TO REQUEST THIS AS AN EXCEPTION, ALONG WITH A SITE PLAN OR A SUBDIVISION SITE PLAN.

SO IF A IF AN ADJACENT HOMEOWNER DID HAVE A CONCERN, THEY WOULD HAVE TO JUST COME AND TALK DURING PUBLIC COMMENTS.

THEY WOULDN'T ACTUALLY BE ABLE TO SPEAK AT THE SAME TIME AS THE ITEM. SO WE'RE MODIFYING THAT TO WRITE THAT IN.

WE'LL HAVE TO TELL PEOPLE TO TALK DURING PUBLIC COMMENTS IF THEY, YOU KNOW, HAVE CONCERNS THAT THEY WANT TO VOICE.

SO THIS WOULD ADDRESS THAT SO THAT IT WOULD ADD THAT PUBLIC HEARING PROCESS AS PART OF THAT EXCEPTION REQUEST.

NEXT, LOOKING AT SUBDIVISIONS, THIS WOULD MODIFY THE LOT DEPTH TO WIDTH EXCEPTION LANGUAGE.

IT WAS PREVIOUSLY WRITTEN JUST AS A STRAIGHT NUMBER OF TWO AND ONE HALF TIMES.

THE WIDTH IS WHEN THE EXCEPTION IS TRIGGERED.

THE REASON THAT'S ALWAYS BEEN IN PLACE IS TO TRY TO PROHIBIT FLAG LOTS, OR AT LEAST GIVE COUNCIL THE OPPORTUNITY TO LOOK AT THEM AND DECIDE WHETHER THEY WANT TO GRANT THAT EXCEPTION. SO WE'RE JUST PROPOSING TO ADD SOME ADDITIONAL LANGUAGE TO REALLY EXPLAIN THE TYPE OF LOT THAT WE'RE TRYING TO PREVENT, AND ALSO INCORPORATE A VISUAL TO MAKE IT CLEAR.

NEXT LOOKING I'M SORRY, CAN WE JUST GO BACK TO THAT ONE FOR A SECOND? SO IN SOME OTHER COMMUNITIES, I CAN'T SAY THAT I'VE SEEN THIS IN FLOWER MOUND, BUT I'VE SEEN OTHER COMMUNITIES WHERE YOU HAVE VERY NARROW LOTS THAT ARE VERY DEEP, LIKE HOUSES THAT ARE LINED UP. MAYBE THE LOTS ARE 40FT WIDE, BUT THEN THEY GO BACK 150FT.

MAYBE THERE'S AN ALLEY BACK THERE AND YOU WIND UP WITH LIKE A BACKYARD THAT LOOKS LIKE A BOWLING ALLEY.

WOULD IT CHANGING THIS TO JUST SAY FLAG LOTS, WHICH, YOU KNOW, MAKES SENSE? WOULD IT THEN ALLOW VERY NARROW, VERY DEEP LOTS IN SAY SOME OF OUR, OUR LOWER OUR HIGHER DENSITY ZONING DISTRICTS? WELL, IT WOULDN'T CHANGE WHAT THE MINIMUM WIDTH OF THE SETBACK IS ALREADY PERMITTED FOR FOR ALL OF OUR EXISTING ZONING DISTRICTS.

YOU KNOW, POTENTIALLY YOU COULD HAVE TOWNHOME LOTS THAT I THINK COULD BE MORE LONG AND SKINNY.

I THINK THAT'S WHY WE SAW WITH BOTH MONARCH AND THE LA SANTA PROJECTS WHEN THEY CAME FORWARD, THEY REQUESTED TO TO WAIVE THAT EXCEPTION. AND, AND STAFF HAD SAID AT THE TIME WE WERE IN SUPPORT OF IT BECAUSE WE DIDN'T WANT TO BASICALLY TELL PEOPLE THEY HAD TO MAKE THE LOTS LESS DEEP.

YOU KNOW, WE WANTED TO ENCOURAGE THEM TO PROVIDE ADDITIONAL YARD SPACE FOR THE TOWNHOME LOTS.

THAT KIND OF BY DESIGN WOULD BE NARROW. SO, UNDER THE CURRENT ORDINANCE, UNDER THIS AS IT IS TODAY, IF YOU HAD, WHAT WAS IT LIKE 30FT WIDTH FOR THOSE TOWNHOMES? IS IT SOMETHING LIKE THAT? SO YOU COULD ONLY HAVE IT BE 75FT DEEP UNDER THIS ORDINANCE, BUT BY REMOVING THIS THEY COULD THEN GO TO 100FT OR BEYOND. YES. AND THEY JUST COULDN'T HAVE A FLAG LOT RIGHT THERE.

OKAY. I UNDERSTAND. THANK YOU. WE DO HAVE SOME FLAG LOTS IN FLOWER MOUND.

WE DO IN THE WHAT WAS CALLED NEWTOWN FLOWER MOUND NEWTOWN AREA.

LIKE NOT TOO FAR FROM HERE. YEAH IT IS SOMETHING THAT YOU SEE IN SOME OLDER AREAS.

AND SO AGAIN, IF THEY'RE ALREADY ESTABLISHED, THAT'S FINE.

THEY ALREADY YOU ALREADY HAVE A PLATTED LOT. IT WOULD JUST BE IF SOMEBODY IS TRYING TO CREATE A NEW LOT NOW, IT IS STILL POSSIBLE THAT THE COUNCIL WOULD HAVE ONE OF THOSE COME FORWARD.

I THINK IF SOMEBODY WAS TRYING TO ADD ON TO ONE, LIKE EVEN IF YOU HAD AN EXISTING FLAG LOT AND THEY WERE KIND OF INCORPORATING A PIECE THAT WAS NEAR IT, BUT REALLY CREATING A NEW LOT NEW DIMENSIONS, THEN THAT COULD STILL END UP COMING BACK TO COUNCIL BECAUSE IT REALLY WOULD STILL BE THE FLAG. BUT LIKE I SAID, WE DON'T WE DON'T WANT ANYBODY TO CREATE THEM NEWLY.

IT JUST CREATES IT CREATES STRANGENESS WHEN, YOU KNOW, YOU BASICALLY HAVE SOMEBODY A LITTLE PIECE OF THEIR LOT IS LIKE WRAPPING AROUND THE SIDE OF YOURS TO GET TO THE STREET, AND THEN YOU CAN END UP WITH CONFLICTS OR NOT REALIZING WHERE YOUR PROPERTY ENDS AND THEIRS STARTS.

AND, YOU KNOW, IT'S GENERALLY NOT GOOD PRACTICE FOR HOW YOU LAY OUT SUBDIVISIONS.

AND PROBABLY EVEN IF SOMEBODY TRIED TO ARGUE WITH IT, POTENTIALLY WE COULD USE IN KIND OF THE LANGUAGE THAT SPEAKS TO TRAFFIC AND THAT SORT OF THING. WE WOULD HAVE SOME LEEWAY THERE, BUT THIS IS JUST ACTUALLY MAKING IT PART OF OUR REGULATIONS FOR NEW SUBDIVISIONS, SO THAT IT WILL ENSURE THAT'S PLATTED AS AN EASEMENT TO ACTUALLY PROVIDE THAT TURNAROUND AREA.

AND YOU HAVE TO DO IT FOR BASICALLY ACCOMMODATING A FULL SIZE BOX TRUCK.

AND SO YOU CAN SEE THIS IS AN IMAGE. IT KIND OF SHOWS THE THERE'S A MODEL THAT YOU CAN RUN THAT IT MAKES SURE THAT THAT SIZE VEHICLE CAN MAKE ALL THE TURNS NECESSARY SO THAT BASICALLY THEY WOULDN'T HAVE TO BACK OUT INTO THE STREET, THEY WOULD HAVE ADEQUATE ROOM TO TURN AROUND.

SO, WE'RE SUGGESTING THAT THIS BE WRITTEN INTO THE ORDINANCE JUST AGAIN.

SO THERE'D BE NO QUESTION WE WOULD HAVE A SECTION TO POINT TO FOR WHY YOU HAD TO MEET THAT REQUIREMENT.

CHAPTER 98 ZONING. LOOKING AT JUST THE MINIMUM FRONT YARD FOR CAMPUS COMMERCIAL AND CAMPUS INDUSTRIAL DISTRICTS.

I THINK I MENTIONED THIS BEFORE, AND IT'S AN OLD STANDARD THAT WAS STILL IN PLACE, SIMILAR TO THE STANDARD THAT OTHER DISTRICTS ARE HELD TO, BUT IT'S A LITTLE DIFFERENT. AND SO THIS IS JUST PROPOSING TO MATCH WHAT ALL THE OTHER NONRESIDENTIAL ZONING DISTRICTS SAY.

BASICALLY, THEY ALL SAY THERE SHALL BE NO MINIMUM FRONT YARD REQUIREMENT SUBJECT TO SECTION 98-1026.

SO THERE ARE SEVERAL, SO SEVERAL DIFFERENT KIND OF SPECIAL CIRCUMSTANCES THAT ARE CALLED OUT IN 98-1026.

BUT IN GENERAL, THE STANDARD WE SEE THE MOST, WHAT WE HOLD PEOPLE TO IS MAJOR ARTERIALS, MINIMUM 60 FOOT FRONT SETBACK, AND ON ALL OTHER STREETS YOU CAN EITHER DO A 30 FOOT FRONT SETBACK WITH NO PARKING IN THE FRONT YARD, OR A 60 FOOT FRONT SETBACK THAT WOULD ALLOW SOME PARKING WITHIN IT.

AND SO WE'RE JUST PROPOSING TO MATCH THAT STANDARD WE HAD.

THERE USED TO BE SOME LANGUAGE ALSO ABOUT LANDSCAPING THAT THAT WAS THIS OLD LANGUAGE AND YOU KNOW, TOOK THAT FORWARD TO COUNCIL HAVE ALREADY TAKEN THAT OUT. AND THIS WAS JUST MY OVERSIGHT.

I MISSED UPDATING THE FRONT SETBACK AS WELL TO MATCH THAT PARKING AREA LIGHTING.

SO AGAIN, THIS CAME FROM THE PAST WORK SESSION WITH TOWN COUNCIL TO TALK ABOUT LIGHTING.

SO I WOULD NOW SAY THE MAXIMUM KELVINS OF LIGHT POLE STANDARDS IN PARKING AREAS SHALL NOT EXCEED 3000.

LASTLY, LOOKING AT FEES SO RECOMMENDS UPDATING FEE EXPLANATIONS IN APPENDIX A TO MATCH CURRENT PRACTICES.

SO AGAIN HAD MENTIONED THIS CHANGE FOR THE INSPECTION OF PUBLIC INFRASTRUCTURE AND DRAINAGE IS COMING FROM A LEGISLATIVE CHANGE.

SO, THE LEGISLATURE PASSED A NEW ORDINANCE THAT SAID YOU COULDN'T BASE THIS ON THE COST OF THE INFRASTRUCTURE.

SO PREVIOUSLY THE TOWN WAS CHARGING 3.15% OF THE COST.

BUT SO NOW IT CAN ONLY BE BASED ON ACTUAL INSPECTION COSTS.

AND SO, WORKING WITHIN THE PARAMETERS OF THAT LEGISLATION THAT WAS WRITTEN, WE'VE COME UP WITH A PROCESS TO ACTUALLY HAVE AN ENGINEERING CONSULTANT REVIEW THIS. THEY COME UP WITH THEIR SCOPE AND FEE.

AND THEN AFTER REVIEWING THE PLANS, THEY SAY THIS IS WHAT WE WOULD CHARGE YOU TO INSPECT THIS.

AND SO THEN WE CAN APPLY THAT TO THE PROJECT.

BECAUSE IT'S VERY DIFFICULT TO DO IT BASED ON OUR ACTUAL INSPECTION COSTS BECAUSE IT REALLY DEPENDS, YOU KNOW, DOES DO THESE PEOPLE DO A GREAT JOB AND THEY GET IT RIGHT ON THE FIRST SUBMITTAL? OR DO WE HAVE TO COME BACK AND DO FIVE MORE INSPECTIONS OR AND SO TO KNOW ON THE FRONT END EXACTLY HOW MUCH IT'S GOING TO COST US IS DIFFICULT.

SO THAT'S WHY WE USE THIS, THIS ALLOWANCE THAT WAS WRITTEN IN THE LEGISLATION.

IT DID SAY YOU COULD GET A COST ESTIMATE FROM A THIRD PARTY AND USE THAT.

SO, WE WENT WITH THAT. ALSO IT'S ADDING THE NONREFUNDABLE DEPOSIT FEE OF $300 FOR THAT SITE DEVELOPMENT PERMIT.

SO IT'S NOT ACTUALLY ADDING ADDITIONAL FEES. OVERALL.

THAT WOULD JUST BE APPLIED TOWARD THE TOTAL COST OF THE PERMIT, BUT IT'S ASKING THE APPLICANT TO PUT SOMETHING IN UP FRONT SO THAT YOU DON'T HAVE PEOPLE THAT MAKE SUBMISSIONS. STAFF SPENDS TIME LOOKING AT IT, AND THEN THEY JUST, YOU KNOW, WADE, AND DON'T DO ANYTHING FOR SIX MONTHS BECAUSE THEY DON'T REALLY HAVE ANY. THEY DON'T REALLY HAVE ANYTHING INVESTED. AT THIS POINT. IT WAS EASY TO JUST MAKE A SUBMISSION AND BE ABLE TO SAY, CHECK A BOX SOMEWHERE THAT SAID, OH YEAH, MY APPLICATION IS UNDER REVIEW.

SO THEY HAVE A LITTLE BIT MORE INCENTIVE TO BE READY TO SUBMIT WHEN THEY PUT THAT IN.

AND THEN THIS AND THIS IS JUST SOME EXPLANATION DOWN AT THE BOTTOM.
